Bankruptcy proceedings from the point of view of the official receiver

Abstract:

Předmětem bakalářské práce „Konkurzní řízení z pohledu správce konkurzní podstaty“ je rozbor konkurzního řízení a činnosti správce konkurzní podstaty v platné právní úpravě. V první části nastiňuji samotný vznik konkurzního práva a jeho vývoj. Dále pak popisuji samotný průběh konkurzního řízení, úlohu správce konkurzní podstaty a snažím se nastínit a řešit nedostatky právní úpravy zákona o konkurzu a vyrovnání. V závěru práce se zamýšlím nad účinností a důležitostí funkce správce konkurzní podstaty a nutností rekodifikace úpadkového práva v České republice.

Abstract:

My bachelor dissertation „Insolvency proceeding from the bankrupt asset manager‘s view“ is an analysis of the insolvency proceeding and the duty of bankrupt asset manager during the proceeding in a valid legal form. The first part talks about the origin of the law of bankruptcy. Further I describe the course of insolvency proceeding, the task of bankrupt asset manager and shortcomings of the legal regulations of the isolvent law with suggestions for it‘ s improvement. The conclusion talks about the effectivity and importace of of the function of the bankrupt asset manager and the necessity of recodification the banktrupcy law.
