Legal regulation of civil service in the Czech Republic

Abstract:

Diplomová práce se zabývá právní úpravou státní služby v České republice, a sice zejména služebním poměrem státních zaměstnanců dle zákona č. 234/2014 Sb., o státní službě. Tato práce je rozvržena do pěti kapitol a poskytuje ucelený pohled na tuto problematiku. Úvodní kapitola obsahuje vývoj legislativy státní služby spolu s procesem přijetí zákona o státní službě. Zmiňuji také služební poměr příslušníků bezpečnostních sborů a vojáků z povolání. V diplomové práci je charakterizován samotný vznik, změny a zánik služebního poměru včetně práv a povinností státních zaměstnanců. Poslední kapitola se zaměřuje na hodnocení a odměňování státních zaměstnanců. Cílem této práce je analýza zákona o státní službě, poukázání na případné nedostatky současné právní úpravy a navržení jejich řešení. Dalším cílem práce je posoudit, zda zákon o státní službě splňuje tři hlavní principy stabilizace, depolitizace a transparentnosti.

Abstract:

The diploma thesis deals with the legal regulation of the civil service in the Czech Republic, namely the service relationship of civil servants according to Act No. 234/2014 Coll., On Civil Service. This thesis is divided into five chapters and provides a comprehensive view of this issue. The introductory chapter contains the development of the civil service legislation along with the process of adopting the Civil Service Act. I also mention the service of security officers and professional soldiers. The diploma thesis characterizes the origin, changes and termination of the service relationship, including the rights and duties of civil servants. The last chapter focuses on the evaluation and remuneration of civil servants. The aim of this work is to analyze the law on the civil service, point out the shortcomings of the current legislation and, if necessary, propose their solution. Another aim of the thesis is to assess whether the Act on Civil Service meets three main principles of stabilization, depoliticization and transparency.
