National Implementation of a EU Directive Inconsistent with the National Constitutional Order
Abstract:
Cílem diplomové práce je poukázat na jednotlivé aspekty transpozice směrnic, které jsou v rozporu s ústavním pořádkem. Práce se prvně soustředí na analýzu přednosti práva EU jak z pohledu Soudního dvora EU, tak z pohledu členských států. Práce se taktéž zabývá přístupy ústavních soudů k přezkumu ústavnosti implementačních předpisů a následkům nenáležité implementace.
Abstract:
The aim of this thesis is to point out several aspects of implementation of directives which are inconsistent with the national constitutional order. The thesis concentrates firstly on analysis of EU law primacy as well from the perspective of Court of Justice as from the perspective of member states.
