The correlations between politicians rent-seeking efforts and the issuing of a change/modification of the municipality´s zoning plan

Abstract:

Cílem této práce je zjistit v jakých fázích procesu schvalování změny/úpravy územního plánu dochází k průtahům a jaké okolnosti mají na tuto situaci vliv, a to za pomoci analýzy schvalovacího procesu změny/úpravy územního plánu v hlavním městě Praze a komparace tohoto procesu s ostatními českými obcemi. Dále navrhnout změny v tomto procesu, které by celý proces urychlily či zefektivnily a případné průtahy odstranily. Na závěr ověřit hypotézu, že zákonná úprava procesu schvalování změny/úpravy územního plánu vytváří prostor pro politiky k dobývání renty. Dané téma je velmi aktuální, jelikož územní plán je dokument, který se neustále mění a vyvíjí. Promítají se do něj nové potřeby veřejnosti, vlastníků pozemků a developerských firem. Průtahy v jeho procesu schvalování tak působí neefektivně na ekonomiku a trh. Aktuálnost a zajímavost tohoto tématu je dána také tím, že problematika je řešena v hlavním městě Praze, což je obec, jež má svůj proces schvalování změny/úpravy územního plánu upraven ještě dalším právním předpisem na rozdíl od ostatních českých obcí.V první části jsou objasněna teoretická východiska, která se vztahují k problematice teorie veřejné volby, dobývání renty, byrokracie, územního plánování a změny/úpravy územního plánu, a je zde popsána legislativa, která tuto problematiku vymezuje. Dále je rozpracován proces schvalování změny/úpravy územního plánu dle platné legislativy. Na závěr teoretické části jsou uvedena metodologická východiska pro část praktickou. Praktická část se zabývá popisem procesu schvalování změny/úpravy územního plánu v hlavním městě Praze a jeho následnou komparací s ostatními českými obcemi. Z tohoto úseku vyplývá, že hlavní město Praha má svá specifika daná platnou legislativou, ale jedná se spíše o nepatrné odlišnosti. Problém může nastat v možné delší době procesu schvalování změny/úpravy územního plánu v Praze, která může být o něco delší právě díky specifikům. Následuje analýza procesu schvalování změny/úpravy územního plánu v hlavním městě Praze, zejména průměrné délky trvání, délky trvání jednotlivých fází či délky trvání vyjádření jednotlivých orgánů. Z této analýzy vyplývá, že doba trvání změny/úpravy územního plánu v Praze se pohybuje okolo 7 let, nejdéle se vyjadřujícím orgánem je Rada hlavního města Prahy a nejdelší je třetí fáze procesu. Na základě zjištěných informací práce obsahuje možné důvody průtahů, jako například zdržování podnětů na změnu/úpravu u asistentů a poradců; důvody jejich vzniku - například zákonná nevynutitelnost změny; a možné návrhy řešení s inspirací v zahraničí. Následně jsou uvedeny možnosti, jakými lze zefektivnit současný průběh procesu pořizování změny/úpravy územního plánu. Následuje úvaha, jak tyto průtahy mohou negativně ovlivňovat ekonomiku a trh v souvislosti s cenami bytů.

Abstract:

The aim of this work is to find out at what stages of the process of approving the change/modification of the zoning plan delays occur and what circumstances affect this situation, by analysing the approval process of the change/modification of the zoning plan in the capital Prague and comparing this process with other Czech municipalities. Further to propose changes to this process to speed up or streamline the process and remove any delays. Finally, verify the hypothesis that the statutory regulation of the planning change/modification process creates scope for rent-seeking policy.The subject is very topical as the Territorial Plan is a document that is constantly changing and evolving. It reflects the new needs of the public, landowners and property developers. Delays in its approval process thus inefficiently affect the the economy. The topicality of this issue is also due to the fact that the is dealt with in the capital Prague, a municipality which has its zoning plan change/modification process regulated by yet another legislation, unlike other Czech municipalities.In the first part, the theoretical recourses related to the problematics of public choice theory, rent-seeking, byrocracy, land-use planning and its modificatoin and the process‘ legislation are clarified. The proces of changing the zoning plan by the legislation is also described. At the end of the theoretical part, the methodological bases for the practical part are given.The practical part describes the process of approving the changes of the zoning plan in the capital Prague and it‘s subsequent comparison with other czech municipalities. It follows from this section that the capital Prague has its specifics, but these are rather minor differences, the problem may arise when there is longer period of the approval process of the change/modification of the Prague zoning plan, which may be due to specifics. What follows is an analysis of the change/modification process in the Prague capital zoning plan, in particular the average duration, the duration of each stage or the duration of each institution's comments. This analysis shows that the duration of the zoning plan proceedings is 7 years, the longest-serving subject is the Council of the Capital of Prague, and most often the third stage of the process takes the longest. On the basis of the information found, the work contains possible reasons for delays, such as delaying incentives for change/modification by assistants and advisors; reasons for their emergence, such as the legal non-enforceability of the change; and possible suggestions for solutions with inspirations from abroad, where the process is self-improved and consequently inspired by fewer functional areas. What follows is an assumption of how these delays negatively affect the economy and the market, in the context of a rise of the house prices.
