Abstract:

Diplomová práce je zaměřena na vývojové stadium pokusu trestného činu a věnuje se některým otázkám, které jsou s tímto vývojovým stadiem trestné činnosti spojeny. Cílem práce je systematický rozbor pokusu trestného činu dle současné právní úpravy, ale i z hlediska historického, poukázat na problematické oblasti a případné nedostatky, které se mohou vyskytovat v praxi. Práce je koncipována systematicky, první část se zaměřuje na definici základních pojmů úzce spjatých s pokusem trestného činu. Následuje stěžejní část práce, ve které je proveden ucelený rozbor pokusu trestného činu, předloženo jeho vymezení v současné právní úpravě a následuje rozbor znaků i trestnosti pachatele. Diskutovanou a jednou z nejvíce sporných problematik trestního práva je institut nezpůsobilého pokusu trestného činu. V diplomové práci jsou vymezeny dva základní pohledy na institut nezpůsobilého pokusu trestného činu z historických nauk, a to z pohledu objektivní teorie kladoucí důraz na nebezpečnost jednání pachatele, a subjektivní teorie poukazující na zlý úmysl pachatele. V praktické části diplomové práce jsou zahrnuty tři konkrétní případy související s pokusem trestného činu, na kterých je problematika názorně popsána dle současných právních norem. Práci uzavírá stručné shrnutí uvedené problematiky a několik úvah de lege ferenda v porovnání se současnou právní úpravou.

Abstract:

The diploma thesis is comprehensively focused on the development stage of an attempted crime and some issues that are connected with this development stage of criminal activity. The aim of the work is a systematic analysis of the attempted crime according to current legislation, but also from a historical point of view, pointing out problematic areas and possible shortcomings that may occur in practice. The thesis is designed systematically, where in the first part it is focused on the definition of basic concepts that are closely related to the attempted crime. The key part of the work follows, where a comprehensive analysis of the attempted crime, its definition in current legislation, analysis of the characteristics and criminality of the offender is carried out. A discussed and one of the most disputed issues of criminal law is the institute of ineligible attempted crime. In the thesis, two basic views of this institute from historical studies will be defined, namely from the point of view of the objective theory, which emphasizes the dangerousness of the perpetrator's actions, and the subjective theory, which emphasizes the evil intent of the perpetrator. In the practical part of the diploma thesis, three specific cases related to an attempted crime are included, in which the issue is vividly described according to current legal standards. The work concludes with a brief summary of the mentioned issue and a few de lege ferenda considerations in comparison with the current legislation.
