Creation of the State Budget and its legal aspects

Abstract:

Zákon o státním rozpočtu je jedním ze základních zákonů České republiky, prostřednictvím kterého se zajišťuje financování zákonem stanovených plateb a platby na chod státní správy. Jde cyklický proces, který znamená, že zákon o státním rozpočtu se schvaluje každý rok a jeho platnost a účinnost se vztahuje jen k jednomu roku. Právní úprava tvorby zákona o státním rozpočtu ČR má několik podob, z nichž základní právní normou je ústavní zákon č. 1/1993 Sb., Ústava České republiky, kde v ustanovení čl. 42 je stanoveno, že návrh zákona o státním rozpočtu podává pouze vláda a pouze Poslanecká sněmovna Parlamentu ČR zákon o státním rozpočtu schvaluje, což je vyjádřeno v druhém odstavci čl. 42 tak, že návrh státního rozpočtu předložený vládou, projednává na veřejné schůzi a usnáší se o něm jen Poslanecká sněmovna Parlamentu ČR. Z této dikce jednoznačně vyplývá, že zákon o státním rozpočtu již nepodléhá schválením Senátu Parlamentu ČR, jak je tomu u ostatních zákonů. Tuto zvláštnost najdeme tedy pouze u schvalování rozpočtového zákona. Proces schvalování zákona o státním rozpočtu je v mnoha případech doprovázen změnami jiných právních norem, na které je zákon o státním rozpočtu navázán. Jde především o právní normy, které ovlivňují příjmovou a výdajovou stranu státního rozpočtu. Zákon o státním rozpočtu má zabezpečit zákonný rámec pro čerpání veřejných finančních prostředků na mandatorní výdaje v podobě důchodů, sociálních dávek, podpor v nezaměstnanosti, výplat nemocenských dávek apod. a vládní výdaje, které jsou určeny pro zabezpečení chodu veřejné správy. K tomu jsou určeny závazné a průřezové ukazatele jednotlivých kapitol státního rozpočtu, které mohou být překročeny jen ze závažných důvodů a zákonem stanovené výši. Výše uvedené platí obdobně i pro příjmovou stranu státního rozpočtu.

Abstract:

The State Budget Act is one of the basic statutes of the Czech Republic used to ensure the financing of payments stipulated by law as well as payments for running the state administration. This concerns a cyclical process, which means that the State Budget Act is approved every year and its validity and effectiveness only pertains to one year. The legislation for the creation of the State Budget Act of the Czech Republic takes several forms. Of these, the basic legal regulation is Constitutional Act No. 1/1993 of the Collection of Laws (Coll.), the Constitution of the Czech Republic, wherein it is stipulated in the provisions of Article 42 that a draft State Budget Act is only put forward by the government, and only the Chamber of Deputies of the Parliament of the Czech Republic approves the State Budget Act, which is expressed in the second paragraph of Article 42 so that the draft state budget is submitted by the government, it is discussed at a public session, and only the Chamber of Deputies of the Parliament of the Czech Republic decides upon it. This wording clearly indicates that the State Budget Act is not subject to approval by the Senate of the Parliament of the Czech Republic, as is the case with the other remaining laws. This particular quality is something that we only come across in the approval of the Budget Act. In many cases the process of approving the State Budget Act is accompanied by changes to other legal regulations which the State Budget Act is tied to. This primarily concerns legal regulations which influence the income and expenditure side of the state budget. The State Budget Act is supposed to ensure a legal framework for the utilisation of public funds for mandatory expenditures in the form of pensions, social security benefits, unemployment benefits, the payment of sickness benefits, etc. as well as government expenditures which are intended for ensuring the running of the public administration. Mandatory and cross-sectional indicators of individual chapters of the state budget have been designated for this purpose. These may only be exceeded for serious reasons and within a statutorily defined amount. The aforementioned also similarly applies to the income side of the state budget.
