Application of Commonwealth Sanctions to Member States

Abstract:

Tato bakalářská práce se zabývá sankcemi, které byly uvaleny organizací Commonwealth na svoje členské státy. Cílem této práce bylo představení činnosti organizace Commonwealth ukázat, na které členy aplikovala sankce, proč se tomu tak stalo a konečně, jaké to mělo na vybrané státy dopad. V začátku práce bylo nezbytné představit samotnou organizaci Commonwealth, její postupné formování a základní listiny a orgány, o které se její činnost opírá. Následovalo přiblížení kritérií, jež musí státy splňovat, chtějí-li být členy organizace a následně nástrojů Commonwealthu, které jsou použity ve chvíli, kdy stát nějaké kritérium porušuje. Abychom mohli zcela pochopit existenci Commonwealthu, bylo nutné poukázat na cíle organizace. Následně přišly do popředí sankce, u kterých bylo nutné představit jejich druhy a funkci, aby bylo možné pochopit celý kontext práce. Ve druhé části práce je možné nalézt konkrétní státy, na které byly sankce z různých důvodů aplikovány. Nejprve je nastíněno historické pozadí jednotlivých států a postupný vývoj, kterým došlo k tomu, že byl stát sankciován. Jako první je pojednáváno o Jihoafrické republice, následně Pákistánu, Fidži, Nigérii, Sierra Leone a na konec o Zimbabwe. Typy uplatňovaných sankcí se lišily podle toho, čím se daný stát provinil. V případě Jihoafrické republiky se jednalo například o zákaz dovozu zemědělských surovin. V případě Nigérie Commonwealth následoval rozhodnutí EU a uvalil na zemi zbrojní embargo. Některé z uváděných států byly po dobu určité doby vyloučeny z rad Commonwealthu, v horším případě jim bylo členství v organizaci zcela pozastaveno. Tento typ sankce je hojně využíván z důvodu malé finanční náročnosti. Nicméně ve většině případů, sankce uvalené Commonwealthem jsou spíše neefektivní.

Abstract:

This bachelor thesis discusses sanctions which were imposed by Commonwealth on its member states. The purpose of this study is to introduce the Commonwealth organisation, demonstrate member states which were subject to sanctions, justify the rationale behind the imposed sanctions and to discuss the implications of sanctions on selected states. Firstly, it was essential to introduce the Commonwealth organisation, its gradual formation, its fundamental legislation and institutions which govern the organisation. Secondly, this study specified criteria which must all states meet in order to be members of the Commonwealth and also discussed Commonwealth instruments which are used when a member state violates a criterion. However, in order to fully understand the Commonwealth organisation, it was necessary to mention the aims of this organisation. Finally, this study explained the types of sanctions used by the Commonwealth and their purposes to understand the concept of this work. In the second part of this study, examples of specific states on which sanctions were imposed can be found. Historical background of each state and the gradual development which led to sanctions imposed on each state was discussed. This study discusses the case of South Africa, Pakistan, Fiji, Nigeria, Sierra Leone and Zimbabwe. The sanctions imposed on each country were different regarding the different criteria violations of the country. In the case of South Africa, a ban on the imports of some agricultural raw materials was imposed. However, in the case of Nigeria, the Commonwealth followed the decision of the European Union and imposed an arms embargo on the country. Some of the listed states have been expelled from the Commonwealth for a period of time, in the worse case, they were completely suspended from membership in the organisation. This type of sanction is widely used because of its low financial demands. However, in most cases, sanctions imposed by the Commonwealth are not effective.
