Abstract:

V práci shrnuji jak své poznatky o dozoru nad detencí z let 2007 až 2012, tak i své názory na některé obecnější otázky spjaté s tímto dozorem. Popisuji souvislost dozoru nad věznicemi s principem ultima ratio a s naplňováním účelu trestu. Uvádím počty osob ve věznicích v tuzemsku i zahraničí a odůvodňuji svou skepsi ohledně brzkého poklesu těchto počtů v České republice. Dozor nad detencí porovnávám s dozorem nad zákonností v přípravném řízení trestním se závěrem, že pouze dozor nad detencí je plnohodnotným dozorem. Všímám si rovněž mezinárodních dokumentů týkajících se výkonu detence a významných rozsudků Evropského soudu pro lidská práva. Závěrem uvádím základní principy, na nichž by měl být dozor nad detencí založen.

Abstract:

At work I summarize my findings about the supervision of detention from the years 2007 through 2012, and my views on some of the broader issues associated with this control. I describe the link of supervision of prisons with the principle of ultima ratio and fulfilling the purpose of the punishment. I present the numbers of people in prisons in the Czech Republic and abroad, and my scepticism about the early decline in these numbers in the Czech Republic. The Supervision of the detention comparing with the supervision of legality in preliminary hearing with the conclusion, that only the supervision of the detention is full. I also notice the international documents related to the enforcement of detention and the relevant judgments of the European Court of human rights. In conclusion, I present the basic principles on which the supervision of detention should be based.
