The issue of access of medic to persons deprived of their legal capacity in a medical institution

Abstract:

Teoretická část obsahuje výklad starého a nového občanského zákoníku vztahující se na způsobilost k právním úkonům, lidská práva obecně a práva duševně postižených, legislativní specifika péče o klienty s upravenou způsobilostí ve zdravotnickém zařízení, charakteristiku vybraných duševních poruch a psychologii duševně nemocných. Pro získání poznatků byla použita odborná literatura. Informace v praktické části byly získávány pomocí kvalitativně-kvantitativního výzkumu. Pomocí rozhovorů bylo zjištěno, že klienti s upravenou způsobilostí k právním úkonům mají dostatek informací, které souvisejí s jejich právní způsobilostí. Jako největší úskalí z toho pramenící vidí v nedostatku finančních prostředků. Negativní zkušenost se zdravotníky měla nadpolovina respondentů. Z dotazníků vyplývá, že sestry nejsou svázány předsudky, které by pramenily z nedostatečné informovanosti o dané problematice. Sestry pracující na psychiatrických odděleních mají rozsáhlejší odborné vědomosti než sestry pracující na jiných odděleních. Obě dvě skupiny se neobávají kontaktu s klientem s upravenou způsobilostí a mají zájem o další vzdělávání v této problematice.

Abstract:

The theoretical part provides an interpretation of the old and the new Civil Code relating to legal capacity, the human rights of disabled persons , legislative specifics of care for clients with customized competences in a health care facility , the characteristics of selected mental disorders and psychology mentally ill. Specialized literature was used to obtain the knowledges. The information in the practical part were obtained using qualitative and quantitative research. Using interviews, it was found that clients with customized legal capacity have sufficient information relating to their legal capacity . As the biggest pitfalls of the resulting sees a lack of funds. Negative experiences with health professionals should nadpolovina respondents. The questionnaires show that nurses are not bound prejudices that would stem from a lack of awareness about the issue . Nurses working in psychiatric departments have extensive technical knowledge than nurses working in other departments. The two groups are not afraid of contact with the client with a modified capacity and are interested in learning more about this issue.
