Duality of Record Administration in the Context of Executory Court Role in the Executory Proceeding

Abstract:

Předložená diplomová práce se zabývá důsledkem duality vedení spisu v exekučním řízení. V tomto působí dva orgány – exekuční soud a soudní exekutor, přičemž práce předkládá shrnutí právní úpravy jak obecně vztahující se k exekučnímu řízení, tak zvlášť uvedenou k vedení spisu, zastupování a doručování. Další část práce je věnována identifikaci problematických míst právní úpravy vztahující se ke vzájemné spolupráci obou orgánů. Poslední část práce uzavírá celé téma návrhem změn pro lepší fungování exekučního řízení.

Abstract:

This thesis deals with the duality result of file-keeping in enforcement proceedings. Two public authority are involved - the execution court and judicial enforcement official. Here the thesis presents a summary of the legislation generally applicable to the enforcement proceeding as well as file management, representation and delivery. The following part is devoted to identifying problematic areas of legislation concerning cooperation of both public authorities. The last part concludes the whole topic of a proposal for amendments to improve the functioning of enforcement proceedings.
