The Korean War and the issue of human rights

Abstract:

The bachelor thesis presents the period before the Korean War, the course of the Korean War itself and the subsequent view of this conflict and the individual events within it from the perspective of International Humanitarian Law. The first part of this thesis, which has two chapters, aims to introduce the reader to the events preceding the Korean War. The first chapter describes how the annexation of the Korean peninsula by Japan came about and what effects this had on Korean society and subsequent developments in the territory. The second chapter then describes the events and reasons why, after the surrender of Japan in 1945, the Korean peninsula was not liberated, but instead came into being as two separate state entities (the Republic of Korea and the Democratic People's Republic of Korea). The third chapter of this thesis deals with the actual conduct of the Korean War, describing the various stages from the initial DPRK attack that began on 25 June 1950 to the conclusion of the armistice in 1953. The fourth chapter of this thesis briefly discusses the development of International Humanitarian Law and its basic characteristics that are applied within its framework. The last fifth chapter constitutes the most substantial chapter of this thesis. Its aim is to demonstrate, through specific cases that took place during the Korean War, whether and in what way there were violations of International Humanitarian Law and the Geneva Conventions of 1949, respectively, which have been applied in this thesis to the issue of prisoners of war and civilians most affected by these events.

Abstract:

Bakalárska práca prezentuje obdobie pred Kórejskou vojnou, priebeh Kórejskej vojny samotnej a následný pohľad na tento konflikt a jednotlivé udalosti v rámci neho z pohľadu Medzinárodného humanitárneho práva. Prvá časť tejto práce, ktorá ma dve kapitoly, má za cieľ čitateľovi priblížiť udalosti pred Kórejskou vojnou. Prvá kapitola opisuje, akým spôsobom prišlo k anexii Kórejského polostrova Japonskom a aké dopady to malo na kórejskú spoločnosť a následný vývoj na tomto území. Druhá kapitola následne opisuje udalosti a dôvody, prečo po kapitulácii Japonska v roku 1945 neprišlo k oslobodeniu Kórejského polostrova, ale namiesto toho prišlo ku vzniku dvoch samostatných štátnych útvarov (Kórejskej republiky a Kórejskej ľudovodemokratickej republiky). Tretia kapitola tejto práce sa zaoberá samotným priebehom Kórejskej vojny, pričom opisuje jednotlivé etapy od počiatočného útoku KĽDR, ktorý započal 25. júna 1950, až po uzatvorenie prímeria v roku 1953. Štvrtá kapitola tejto práce stručne rozoberá vývoj Medzinárodného humanitárneho práva a jeho základnej charakteristiky, ktoré sa v jeho rámci uplatňujú. Posledná piata kapitola predstavuje najpodstatnejšiu kapitolu tejto práce. Jej cieľom je na základe konkrétnych prípadov, ktoré sa udiali počas Kórejskej vojny, demonštrovať, či a akým spôsobom dochádzalo k porušovaniu Medzinárodného humanitárneho práva, resp. Ženevských dohovorov z roku 1949, ktoré boli aplikované v tejto práci v otázke o vojenských zajatcoch a civilistoch, ktorých tieto udalosti najviac zasiahli.
