Discretion and duties of Secretary of Municipal Office with Extended Area of Authority

Abstract:

Abstrakt Ke dni 31. 12. 2002 byly zrušeny okresní úřady jako územní orgány státní správy se všeobecnou působností. Větší část pravomocí zrušených okresních úřadů byla převedena na orgány zákonem vymezených obcí s rozšířenou působností a na orgány krajů. V souvislosti s převodem pravomocí vznikl nový typ obecních úřadů, tzv. obecní úřady obcí s rozšířenou působností. V každém obecním úřadu obce s rozšířenou působností je zřízena funkce tajemníka obecního úřadu. Tajemník zajišťuje výkon státní správy v přenesené působnosti, plní úkoly uložené mu zastupitelstvem obce, radou obce nebo starostou, stanoví platy všem zaměstnancům obce zařazeným do obecního úřadu, plní úkoly statutárního orgánu zaměstnavatele podle zvláštních právních předpisů vůči všem zaměstnancům obce zařazeným do obecního úřadu a vydává spisový řád, skartační řád, pracovní řád obecního úřadu a další vnitřní směrnice obecního úřadu. Tajemník obecního úřadu obce s rozšířenou působností plní ještě další úkoly uložené mu zvláštními zákony. Jako téma diplomové práce jsem si vybral práva a povinnosti tajemníka obecního úřadu obce s rozšířenou působností, protože nejsou dosud nikde v literatuře uspokojivě zpracovány.

Abstract:

Abstract Regional or district authorities in Czech republic as the type of local authorities with a general incidence were determined on the date of 31st December 2002. A major part of their agency was transferred on Local Communities with an extensive broad authority determined by the law and on the authorities of Regions. In accordance with the transformation of competencies, a new type of municipal office was established: the Municipal Office with an Extensive Area of Authority. There is a function of a secretary in each municipal office. The secretary ensures the execution of transferred authority of state administration, he serves for the municipal Council or Major, determines the salaries for municipal office staff, fulfils the tasks of an employer statutory body in compliance with special legal regulations in regard of the municipal employees, publishes a nomenclature, shreeding code, working regulations and other municipal office bylaw orders. The secretary of the office with an extended sphere of authority serves many functions which are determined by special regulations. I have chosen as a subject of my thesis dissertation description of all the rights and obligations of a municipal secretary with an extended sphere of authority, because is not yet sufficiently worked-out in any publication hence.
