Trade-mark in a business context

Abstract:

V této práci je věnována pozornost problematice ochranných známek a jejích zasazení do obchodněprávního kontextu. Práce obsahuje definici ochranné známky, její funkci, smysl, účel či způsob jejího oceňování. Práce se zaobírá jak statickým pohledem ve formě přihlašování ochranné známky tak i pohledem dynamickým a to převodem či licencováním ochrané známky. V neposlední řadě práce zpracovává i aktuální pohled na konfliktnost ochranných známek z obchodními firmami i doménovými jmény a dále definuje i ochrannou známku Společenství.

Abstract:

In this master’s thesis I aimed at trademarks and I tried to put them in business law context. I defined the trademark the same way as it’s defined by law and in literature. I analyze national legal arrangement which consists of trademarks law and also of clauses of bussiness law, administrative law and criminal law. Later in the work I clarify the right of priority. In this master’s thesis I aimed not only to capture the static perspective but also the dynamic perspective. The dynamic perspective is represented by transfer of the trademark, by licencing and by relation to franchising. There is an interesting issue in this area these days. It’s the conflict between the trademark legislation and other legal institutes like business firm or domain name. The most attractive issue to me are the domain names that , thanks to newness internet, lack legal arrangement and their conflict with other legal institutes can be solved only on basis of terms of unfair competition law or general law principles.
