The Ombudsman and His Competences in Protecting People Against Discrimination.

Abstract:

Tato diplomová práce se zabývá vymezením působnosti a kompetencí Veřejného ochránce práv v České republice při ochraně před diskriminací v oblasti přístupu ke zdravotní péči. Teoretická část pojednává o vymezení institutu Veřejného ochránce práv včetně historického vývoje získávání jeho kompetencí. Práce analyzuje nejen právní úpravu problematicky ochrany rovného přístupu v pojetí především Antidiskriminačního zákona, ale také uplatnění kompetencí Veřejného ochránce práv v této oblasti. Dále práce v závěru obsahuje zhodnocení jeho kompetencí.

Abstract:

This diploma thesis deals with defining the scope and competences of the Public Defender of Rights in the Czech Republic in protection against discrimination in the area of access to health care. The theoretical part includes the definition of the Institute of the Public Defender of Rights, including the historical development of the acquisition of its competences. The work analyzes not only the legal regulation of the protection of equal access in the concept of the Antidiscrimination Act, but also the application of the competences of the Public Defender of Rights in this area. The thesis contains an evaluation of his competences at the end.
