The concept of independence and impartiality of a judge

Abstract:

Tato diplomová práce se zabývá pojmem nezávislosti a nestrannosti soudce a zárukami, které tuto zásadu společně tvoří. Cílem práce je uvést a vysvětlit základní pojmy a podat ucelený pohled na jednotlivé atributy, kterými jsou jmenování do funkce soudce, neslučitelnost funkcí soudce, neodvolatelnost a neslučitelnost z funkce, kárná odpovědnost soudců a v neposlední řadě také hmotné zabezpečení soudců. Dalším z popisovaných aspektů je také morální integrita soudce, která se v jistém ohledu vymyká všem výše zmíněným. Následující část práce se věnuje konkrétním případům, kde byla namítána nestrannost soudce pro jeho podjatost. V této části práce vyjadřuji svůj nesouhlas s posuzováním subjektivního pohledu soudce na danou věc a domnívám se, že názor soudce by měl být v rozhodnutí o podjatosti rozhodující. V závěru práce uvádím dvě kauzy. Jedna se týká případu, kterému jsem sama byla přítomna a v něm hodnotím chování soudkyň z hlediska nestrannosti a druhým případem je mediální kauza bývalého soudce Ondřeje Havlína, kde jsem se případ pokusila shrnout a vyjádřit souhlas s potrestáním za jeho velmi neprofesionální přístup, který byl zároveň trestným činem.

Abstract:

This thesis is dedicated to the concept of judicial independence and impartiality and the guarantees that constitute this principle. The aim of the thesis is to introduce and explain the basic concepts and to give a comprehensive view of the individual attributes, which are the appointment to the office of a judge, the incompatibility of judicial functions, the irremovability and incompatibility from the office, the disciplinary liability of judges and, last but not least, the material security of judges. Another of the aspects described is the moral integrity of the judge, which in some respects goes beyond all of the above. The following part of the thesis is devoted to specific cases where the impartiality of a judge has been challenged on the grounds of bias. In this part of the thesis, I express my disagreement with the consideration of the judge's subjective view of the case and believe that the judge's opinion should be decisive in the decision on bias. I conclude the thesis with two cases. One concerns a case that I myself was present at, in which I assess the behaviour of judges in terms of impartiality, and the second case is the media case of former judge Ondřej Havlín, where I tried to summarise the case and agree to punish him for his very unprofessional approach, which was also a criminal offense.
