Crime and Punishment - An Economic Analysis of Crime and the Costs of Punishing Crime in Selected European Countries in the Period 2010-2021

Abstract:

Bakalářská práce se zabývá analýzou vývoje fenoménů spojených s trestáním kriminálních aktivit v středoevropských zemích v období 2010-2021. Teoretická část popisuje pomocí hloubkové literární rešerše historii ekonomické analýzy práva, teorii racionální volby, model kriminálního chování Garyho S. Beckera a následný vývoj ekonomie kriminality po Beckerově studii a studie zabývající se vězeňstvím a alternativními tresty především v rámci Evropské unie. Praktická část aplikuje poznatky z teoretické části do praxe za využití dílčích analýz zkoumaných zemí: České republiky, Slovenské republiky, Polska, Maďarska, Rakouska a Spolkové republiky Německo, které jsou následně podrobené podrobné komparaci. Hlavní náplní je analýza fenoménů spojených s vězeňstvím, jako jsou například: vývoj vězeňských populací, denní náklady na vězně, nákladnost vězeňských systémů a případné způsoby užívání elektronického monitoringu jako alternativy k trestu odnětí svobody. Závěr bakalářské práce analyzuje porovnání nákladnosti trestu odnětí svobody a elektronického monitoringu a potvrzuje hypotézu, že alternativní tresty snižují náklady trestání zločinu.

Abstract:

The bachelor thesis deals with the analysis of the development of phenomena related to the punishment of criminal activities in Central European countries in the period 2010-2021. The theoretical part describes the history of economic analysis of law, the theory of rational choice, Gary S. Becker's model of criminal behaviour and the subsequent development of the economics of crime after Becker's study and studies dealing with prisons and alternative punishments, especially within the European Union. The practical part applies the findings from the theoretical part into practice by using partial analyses of the countries under study: the Czech Republic, the Slovak Republic, Poland, Hungary, Austria and the Federal Republic of Germany, which are then subjected to a detailed comparison. The main focus is the analysis of phenomena related to the prison system, such as: the development of prison populations, daily costs per prisoner, the costliness of prison systems and the possible use of electronic monitoring as an alternative to imprisonment. The thesis concludes by analysing the comparison of the cost of imprisonment and electronic monitoring and confirms the hypothesis that alternative sentences reduce the cost of punishing crime.
