Well in the Light of Current Legal Regulation

Abstract:

Tato bakalářská práce pojednává o studnách a jejich postavení z pohledu platné právní úpravy. Hlavním cílem je objasnit právní povahu studny a její vztah k pozemku, na kterém se nachází, především z pohledu veřejnoprávního. První část práce, veřejnoprávní část, popisuje postup nutný k získání povolení novou studnu vybudovat a následně provozovat. Další, soukromoprávní část práce se věnuje studni, jejímu vlastnictví a vztahu k pozemku, na kterém se nachází. Dále je zmíněn vztah studny a katastru nemovitostí. V závěru je zhodnocena platná právní úprava a nedostatky při její aplikaci v praxi.

Abstract:

This Bachelor degree thesis deals with wells and their status in regard to effective legal regulations. The main aim of this work is to clarify a legal status of a well and its relationship to a property on which it is placed, especially in regard to public law. First part of the thesis, public law, describes a procedure necessary to obtain permission to build a well and operate it subsequently. The next, private law part of the thesis, engage in an ownership of a well and relationship to a property on which it is placed. Moreover, there is also mentioned relationship between a well and a land register. In conclusion, the effective legal regulations and deficiencies in practical application are evaluated.
