WTO Dispute Settlement Crisis: The Result of US Mercantilist Policy

Abstract:

Tato práce nabízí případovou studii krize odvolacího tělesa (AB) Svě-tové obchodní organizace (WTO) způsobené Spojenými státy americ-kými. Po teoretickém a historickém uvedení představím základní prin-cipy a funkce WTO s důrazem na roli AB. Po metodologické kapitole se začnu s vysvětlovat proces, který vedl k blokaci AB. Navrhuji přitom dvě možná vysvětlení tohoto procesu zasazená do teorie, která před-stavuji jako hypotézy. Po aplikaci důkazů vyhodnotím, která z hypotéz poskytuje více přesvědčivé vysvětlení. Na závěr představím některé možné implikace plynoucí z krize AB pro budoucí vývoj mezinárodního ekonomického systému.

Abstract:

This thesis provides a case study of the US-caused crisis of the Appel-late Body (AB) of the World Trade Organization (WTO). After theoreti-cal and historical introduction, the thesis outlines the principles and functions of the WTO, emphasizing the crucial role of the AB. After the methodological chapter, I move on to explain the process which led to the AB blockage. I provide two theoretically grounded explanations of the process as hypotheses. After applying evidence, I evaluate which hypothesis provides the more convincing explanation. I conclude by presenting some possible implications of the AB crisis for the future development of the international economic system.
