Směnka v českém právním řádu a její využití při podnikání

Abstract:

Tato bakalářská práce pojednává o konkrétním využití směnky jako cenného papíru platebního i zajišťovacího a následné uplatnění nároků ze směnky v podnikání. Směnka patří k tržní ekonomice a je tradičně spojována s obchodováním. Pomocí dostupné odborné literatury přiblížím principy fungování směnek v ucelené formě. Ovšem vzhledem k tomu, že téma je natolik obsáhlé a svým rozsahem značně převyšuje rámec této bakalářské práce, uvědomuji si, že potenciálním čtenářům zřejmě plně nezaručím se v problematice těchto cenných papírů orientovat. Dalším cílem této práce je zabývat se praktickými aspekty směnky, jejich využití při podnikání a zhodnocení jejich výhod v porovnání s riziky. Dále výklad zaměřený na dispozice se směnkami a také krátké ohlédnutí několika slovy o způsobu uplatňování před soudem. Součástí práce jsou i názorné šablony - přílohy nejčastěji používaných směnek v praxi.

Abstract:

This work is specifically aimed to deal with the problematic of a Bill of exchange (“Bill”), and its further use as a commercial paper in a role of a payable and guaranteeing instrument and its ability to apply its claim in business. A “Bill” is a subject of the trade economy and its traditionally bonded with trade. With the use of available professional literature I will explain the usage of a “Bill” in a consistent form. You must understand that the range of this topic goes far over the scale of this works content. That may prove difficult for future readers to fully grasp the problematic of the Bill of exchange . The secondary goal of this work is focused on practical aspects of the Bill of exchange, its usage in business and the assessment of its advantages compared to the risks. Further in this chapter we shall focus on the disposition of a Bill of exchange and its enforceability in court. You will find descriptive templates, of the most used Bills, in the annexes.
