Abstract:

Alternative dispute resolution is generally understood as extrajudicial proceedings with simultaneous exclusion of the judicial authority. Individual ways of represent an alternative of the judicial system and are defined, more or less, by those features which distinguish them from the system. The choice of particular form of alternative settlement of a given dispute depends on the will and agreement of the parties to a dispute and thus allows the parties to stay in control of their own issues. There is a whole range of possible settlements of disputes arisen between the parties. It always depends on the willingness and openness of the parties to accept one of them. In most of the methods it is purely up to the parties to decide whether to reach a compromise or lose time disputing.

Abstract:

Alternatívne riešenie sporov je vo všeobecnosti ponímané ako mimosúdne riešenie sporov pri vylúčení súdnej právomoci. Alternatívne riešenie sporu predstavuje alternatívu práve k súdnemu konaniu a je definované viac menej tým, čím sa od neho líši. Výber určitej formy alternatívneho riešenia daného sporu závisí od dohody a vôle sporových strán a umožňuje tak stranám ponechať si kontrolu nad svojimi vlastnými záležitosťami. Existuje celá rada možných spôsobov riešenia sporov vzniknutých medzi stranami, no vždy bude záležať na ochote a ústretovosti obidvoch sporných strán sa nejakému z nich podrobiť. Jednotlivé spôsoby mimo súdneho riešenia sporu sa navzájom líšia prevažne mierou formalizácie, kedy najviac formalizovanou metódou je rozhodcovské konanie na jednej strane a na strane druhej sú to neformálne metódy ako mediácia a konciliácia.
