The President in Constituional development in the Slovak republic

Abstract:

The thesis is mainly focused on the position of head of state on our territory. It charts the gradual formation of the role from creation to the present form. The thesis also highlights the important position of head of state in society. It compares the position in countries with half-presidential and presidential form of government where the president has a much stronger position as president in a country with a parliamentary form of government. It emphasises on the powers of head of state of the Slovak Republic, which is described and discussed in detail. At the same time this thesis describes historical development of the head of state position on our country in different periods, as well as the development of head of state outside of our country. This work deals with perceptions of the president and his power and status in the natural division of power in the state. It also observers the actions of the head of state formation into its current form not only in our country but also abroad. In conclusion, this work deals with actual comparison of two forms of government with emphasis on the position of president in these systems. At the same time this thesis shows how different forms of government in the respective countries have a major impact on the position of president in the society and his competences.

Abstract:

Bakalárska práca je obsahovo zameraná hlavne na postavenie hlavy štátu na našom území. Mapuje postupné formovanie tohto inštitútu od jeho počiatku až po súčasnosť. Vyzdvihuje dôležité postavenie hlavy štátu v spoločnosti, v štátoch s poloprezidenskou a prezidentskou formou vlády, kde prezident má oveľa silnejšie postavenie ako prezident v štáte s parlamentnou formou vlády. Dôraz kladie na právomoci hlavy štátu Slovenskej republiky v súčasnej dobe, ktoré podrobne rozoberá a opisuje. Zároveň práca ponúka historický prierez vývoja inštitútu hlavy štátu na našom území v jednotlivých obdobiach, ako aj vývoj hlavy štátu mimo nášho územia. Práca sa zaoberá vnímaním prezidenta z pozície jeho moci a postavením v prirodzenej deľbe moci v štáte. Sleduje kroky inštitútu hlavy štátu a jeho formovanie do súčasnej podoby nielen na našom území, ale aj v zahraničí. V závere práce sa venuje reálnemu porovnaniu dvoch foriem vlády s dôrazom kladeným na postavenie prezidenta v týchto systémoch. Zároveň poukazuje ako rôzne formy vlády v štáte majú zásadný vplyv na postavenie prezidenta v spoločnosti a jeho kompetencie.
