Same-sex unions in Czech politicial discourse

Abstract:

Tématem této diplomové práce je stejnopohlavní manželství coby instituce liberálně-demokratické společnosti. Mojí hlavní tezí je, že gayové a lesby v České republice by neměli pouze usilovat o otevření manželství osobám téhož pohlaví, nýbrž i o zrovnoprávnění alternativních forem soužití, bez ohledu na to, zda v nich figurují homosexuálové nebo heterosexuálové. Opíraje se o současnou liberální a feministickou politickou teorii manželství tvrdím, že bychom neměli považovat za samozřejmé, že stát vylučuje gaye a lesby z manželství, ale že by se stát měl vzdát monopolu na vlastnictví úplně. Liberální stát by měl nechat na samotných občanech, které svazky vzájemné péče si přejí nazývat „manželstvím“. Zároveň by liberální stát neměl prostě nahradit registrované partnerství stejnopohlavním manželstvím, ale místo toho by měl zachovat instituci registrovaného manželství a otevřít ji jak homo-, tak heterosexuálním párům. Tento teoretický argument doplňuji empirickým popisem procesu prosazování legalizace gay a lesbických partnerství ve světě i v České republice.

Abstract:

The topic of this thesis is the same-sex marriage as an institution of the liberal-democratic society. My central claim is that gays and lesbiansin the Czech Republic should aim not only at the mening of marriage to the persons of the same sex, but also at securing equal rights for alternative forms of partnership, irrespective whether its members are homo- or heterosexual. Drawing on the contemporary liberaland feminist political theory of marriage I claim that not only it should not be taken for granted that the state exludes gays and lesbians from marriage, but that the state must completely relinquishits monopoly on marriage. The liberal state should leave it to the Citizen themselves which mutually care-giving unions. They wish to call “marriage.” Also, the liberal state should not just replace domestic partnership with same-sex marriage, as it is proposed by the current Czech campaign for same-sex marriage, but instead domestic partnerships should be left in place and open to both homo- and heterosexual couples. This theoretical argument is supplemented by an empirici description of the proces of legalization of gay and lesbian partnerships arend the world and in the Czech Republic.
