Taxation of Cryptocurrencys

Anotace:

Diplomová práce se zabývá institutem kryptoměn z pohledu finančního práva. Jelikož tento institut je v České republice poněkud nový a právní úprava na něj ještě dostatečně nezareagovala, je stěžejní úlohou práce tento institut charakterizovat, popsat proces jeho vzniku, analyzovat jeho právní a ekonomické aspekty a v neposlední řadě jej systematicky zařadit vedle ostatních produktů finančního trhu. Cílem práce je zhodnocení toho, zda jsou kryptoměny jen dalším z investičních nástrojů na finančních trzích a zda je současná úprava daňového systému může postihnout. Práce je systematicky strukturovaná od procesu vzniku a právní klasifikace kryptoměny přes uvedení jednotlivých druhů daní, které se kryptoměn dotýkají a zakončena možnými úvahy týkající se regulací de lege ferenda.

Abstract:

The thesis deals with the institute of cryptocurrencies from the perspective of financial law. As this institute is somewhat new in the Czech Republic and the legislation has not yet sufficiently responded to it, the main task of the thesis is to characterize this institute, describe the process of its creation followed by analysis of its legal and economic aspects and comparison with other financial market products. The aim of this thesis is to evaluate whether cryptocurrencies are just another means of the investment on the financial markets and whether the current tax system can affect them. The work is systematically structured beginning with the process of formation and legal classification of cryptocurrency, continuing with individual tax types, that affect cryptocurrency and ending with the discussion over possible regulation according to de lege ferenda.
