Realization of Lien

Abstract:

Diplomová práce se zabývá realizací zástavního práva, přičemž práce je zaměřena na nemovité věci. Zástavní právo patří mezi často užívaný prostředek zajištění pohledávky věřitele, jehož pozice se tímto značně posiluje a míra rizika klesá. Diplomová práce rozebírá různé způsoby realizace zástavního práva, zabývá se praktickými důsledky realizace a analyzuje různé způsoby realizace z pohledu zajištěného věřitele. V podstatě existují tři hlavní způsoby, kterými lze realizovat zástavní právo, a to na základě dohody smluvních stran, soudním prodejem zástavy, nebo ve veřejné dražbě.

Abstract:

The diploma thesis deals with the realization of the lien, and the work is focused on real estate. The right of lien belongs to a frequently used means of securing the creditor’s claim, whose position is strengthened considerably by that, and level of risk decreases. The diploma thesis analyses different ways of realization of the lien, deals with the practical consequences of realization and analyses the different ways of realization from the perspective of secured creditor. Basically, there are three main ways in which a lien can be realized, either by agreement of the contracting parties, by the judicial sale of pledge, or by public auction.
