Abstract:

Jako téma této diplomové práce byly zvoleny veřejnoprávni smlouvy. Těm se práce věnuje nejprve v teoretické rovině, následně v rovině jejich praktického využívání v Plzeňském kraji. První, teoretická, část diplomové práce je zaměřena na samu právní úpravu a přístup právní teorie k veřejnoprávním smlouvám. Pozornost je věnována nejen hmotněprávní úpravě, ale také jejich procesní úpravě dle platného správního řádu. Práce shrnuje jejich zákonem vyžadované náležitosti, věnuje se jejich členění dle řady uznávaných autorit správního práva. Poté je prostor v práci věnován rozdílům a specifikům jednotlivých typů smluv - pozornost je zaměřena na smlouvy subordinační, koordinační a také na tzv. smlouvy mezi účastníky. Druhá část práce je věnována praktickému využívání veřejnoprávních smluv v praxi Plzeňského kraje. Po celkovém pohledu (z hlediska statistiky ministerstva vnitra) je důraz kladen na veřejnoprávní smlouvy uzavírané v rámci Plzeňského kraje.

Abstract:

Public contracts were chosen as the topic of this thesis. They are first explained on the theoretical level, followed by their practical use in the Pilsen Region. The theoretical part of the thesis focuses on legislation and the relationship of legal theory with public contracts. Attention is paid not only to substantive legal regulation, but also their procedural adjustment according to the applicable administrative regulations. The work summarizes their requirements set by law, and deals with their categorization according to a number of recognized authorities of administrative law. After that, attention is given to the differences and specifics of individual types of contracts - mainly on subordination and coordination contracts, as well as on so-called contracts between participants. The second part of the work is dedicated to the practical use of public contracts in the Pilsen Region. After an overall view (from the point of view of statistics of the Ministry of the Interior), the emphasis is placed on public contracts concluded within the Pilsen region.
