The role of international courts in environmental protection

Abstract:

Obsahem této diplomové práce je zachytit a vysvětlit úlohu mezinárodních soudů, a to především v oblasti ochrany environmentálního prostředí. Zkoumána je praxe, která za posledních desítek let přinesla rozvoj mezinárodního práva rapidní rychlostí. Důkazem toho může být existence velkého počtu mezinárodních smluv a institutů, jež se zaobírají spory v oblasti životního prostředí. Tyto soudní aparáty přispívají k ochraně a pomalu, ale jistě definují právo na příznivé životní prostředí. Dále skrze své rozsudky napomáhají k řešení sporů, rozhodují o předběžných opatřeních a poskytují poradní posudky. Mezi hlavní devizy těchto institucí především patří pravomoc ukládat sporným stranám povinnost spolupracovat. Svojí činností přispívají k objasňování povinností států a výkladu principů, a tím tak napomáhají k právní jistotě. A i přes skutečnost, že judikatura těchto institucí není vynutitelná a nemá povahu klasického precedentu, tak jako ho známe z anglického práva, tak se těší značného respektu v celé společnosti. Práce soudních institucí má takovou úroveň, že lze mluvit o tom, že tyto instituce se staly nenahraditelnými a značně napomáhají k neustálému vývoji.

Abstract:

The content of this thesis is to capture and explain the role of international courts, especially in the field of environmental protection. The practice that has brought the development of international law at rapid speed in recenty ears. This can bee videnced by the existence of a large number of international treaties and institutes dealing with environmental disputes. These judicial systems contribute to protection and slowly but surely definet heright to a favorable life environment. Furthermore, through thein judgments They help to resolve disputes, decide on in term measures and provide advisory opinions. The main assets of these institutions are, first and foremost, the power to impose obligations on the parties to cooperate. Their activities contribute to clarifying the obligations of states and interpreting the principles, thus contributing to legal certainty. And despite the fact that the case law of these institutions is not enforceable and does not have the character of a classical precedent, as we know it from English law, it use considerable respect through out society. The work of judicialinstitutions has reached such a level that it can be said that these institutions have become irreplaceable and greatly contribute to the continuous development.
