Accused Police Agent in Criminal Proceedings

Abstract:

Tato bakalářská práce pojednává o trestných činech příslušníků Policie České republiky, kteří vystupují jako úřední osoby dle § 127 odst. 1 písm. e) zákona č. 40/2009 Sb., trestního zákoníku, ve znění pozdějších předpisů nebo jako vojáci dle § 114 odst. 4 písm. c) výše uvedeného trestního zákoníku. Jedná se o speciální subjekt, který má zvláštní způsobilost nebo zvláštní postavení a uplatňují se okolnosti podmiňující použití vyšší trestní sazby u jednotlivých trestných činů, které jsou uvedeny v této práci. Policista při řádném neplnění svých povinností a nedodržování zákona, může být i sám v postavení obviněného. Tímto je myšleno dle § 12 odst. 7 zákona č. 141/1961 Sb., o trestním řízení soudním (trestní řád), ve znění pozdějších předpisů, i osoba podezřelá, obviněná, obžalovaná a odsouzená. Na tato jednotlivá postavení osob bude navázáno a pojednáno v jednotlivých stádiích trestního řízení, ať se již bude jednat o zkrácené přípravné řízení, standardní přípravné řízení či řízení před soudem tj. hlavní líčení, které je nejdůležitějším stádiem trestního řízení.

Abstract:

This thesis deals with the crimes of the members of Police of the Czech Republic, who act as officials under § 127, paragraph 1, point. e) of Act No. 40/2009 Coll. Penal Code, as amended, or as soldiers under § 114, paragraph 4, point. c) above mentioned the Criminal Code. This is a special subject that has a special character or special status and apply to circumstances which condition higher sentences for individual crimes that are listed in this work. The policeman in the proper non-performance of obligations and violations of the Act may be himself in the position of the accused. This is meant according to § 12 paragraph 7 of the Act No. 141/1961 Coll. Criminal proceedings (Criminal Procedure Code), as amended, he/she should be in position of the suspect, the accused, indicted and convicted. The status of the individual will be established and discussed in various stages of criminal proceedings, whether it will be a short pre-trial proceedings, the standard pre-trial proceedings or the proceedings before the trial court, ie, which is the most important stage of the criminal proceedings.
