Current Trends and Issues in Czech Territorial Self-Covernment

Abstract:

Územní samospráva, postavená na principech demokratického státu, má v České republice tradici trvající více jak 160 let. Za tu dobu prošla mnoha změnami. V současné době tvoří strukturu územní samosprávy obce a kraje. Od politických změn v roce 1989 se vede široká odborná diskuse, zda je počet obcí v České republice optimální, zda je dobře nastaven rozsah pravomocí jednotlivých orgánů obcí a zda jsou obce dostatečně financovány. Značný vliv má na výše uvedená témata tzv. výkon státní správy v přenesené působnosti a územní členění státu. Se specifickými problémy se musí vypořádat místní samospráva na území hlavního města Prahy. Stejně tak se vede odborná diskuse o počtu, velikosti a hospodaření krajů. Do činnosti územní samosprávy zasahují i další vlivy. Mezi nejvýznamnější lze zařadit rychlý vývoj právního prostředí, elektronizaci, depolitizaci, pojetí veřejné správy jako služby, zvyšování kvality veřejné správy a zvyšování odborné úrovně zaměstnanců a funkcionářů veřejné správy. Jako téma diplomové práce jsem si vybral Aktuální trendy a problémy české územní samosprávy. Téma je v odborné literatuře zpracováno nedostatečně, což je pochopitelné. Odborná literatura reaguje na aktuální stav s určitým zpožděním. Jednotlivé trendy a problémy územní samosprávy lze proto popsat především na základě článků v odborných časopisech a na základě praxe.

Abstract:

The territorial self-government built on the principles of a democratic state has in the Czech Republic a tradition of more than 160 years. During this period, it has undergone many changes. At present, the structure of the territorial self-government consists of municipalities and regions. Since the political changes in 1989, the wide expert discussion has been held on the theme of whether the number of municipalities is in the Czech Republic optimal, whether the scope of the powers of individual municipal bodies is well set and whether the municipalities are adequately funded. These topics are significantly influenced by the so-called “performance of the state administration in the scope of delegated competence” and by the territorial division. The local self-government in the territory of the capital city of Prague has to cope with specific issues. Equally, there is the expert discussion about the number, size and financial management of the regions. The activities of territorial self-government are also affected by other influences. The most important ones may include the rapid development of the legal environment, computerization, depoliticization, understanding public administration as a service, improvement of the quality of public administration and increase of professional level of employees and functionaries of public administration. The theme of this diploma thesis is The Current Trends and Issues of the Czech Territorial Self-government. This theme is inadequately treated in the literature, which is understandable, because the literature responds to the current situation with some delay. Individual trends and issues of territorial self-government can therefore be described primarily on the basis of articles in professional journals and on the basis of experience.
