The History, Present and Prospects of the Economic and Monetary Union in the EU

Abstract:

Anotace Diplomová práce se zabývá historií, současností a perspektivami hospodářské a měnové unie v EU. V první kapitole diplomová práce je charakterizován proces vzniku hospodářské a měnové unie z pohledu ekonomického řádu. Nejprve jsou popsány motivy a příčiny, které vedly k zahájení procesu evropské integrace. Následuje popis jednotlivých integračních stupňů, tj. pásma volného obchodu, celní unie, společného trhu, hospodářské a měnové unie a politické unie. Další část první kapitoly podrobně charakterizuje čtvrtý integrační stupeň ? hospodářskou a měnovou unii. Následuje část věnovaná systému fixních kurzů a následnému vzniku společné měny. Poslední část první kapitoly přináší souhrn přínosů a nákladů společné měny. Druhá kapitola diplomové práce je věnována právnímu ukotvení evropských integračních procesů. Tato část přináší chronologický přehled všech důležitých právních dokumentů ? zakládacích smluv, aktů, plánů a zpráv. V jednotlivých právních dokumentech jsou zdůrazněny v paragrafovém znění vybrané klíčové pasáže. Třetí kapitola diplomové práce analyzuje ekonomické a právní příčiny současné krize hospodářské a měnové unie. Nejprve se zabývá vznikem finanční krize ve Spojených státech, následně na příkladu řecké ekonomiky se věnuje problematice dlouhodobě nevyrovnaných veřejných financí evropských ekonomik, která následně přerůstá v krizi v krizi dluhovou. Závěr kapitoly obsahuje právní ukotvení současného stavu hospodářské a měnové unie. Čtvrtá kapitola diplomové práce se věnuje možným opatřením v oblasti evropské a národní legislativy směřujícím k právní a ekonomické stabilizaci hospodářské a měnové unie. Tato část diplomové práce zaměřuje svoji pozornost nejprve k nutným institucionálním a legislativním změnám právního prostředí Evropské unie s důrazem na připravovaný tzv. ?Fiskální kompakt?. V další části této kapitoly je uveden návrh legislativních změn upravující stav veřejných financí v České republice směřující do oblasti navrhované ?Národní finanční ústavy?. Poslední pátá kapitola diplomové práce je věnována odhadu časového horizontu vstupu České republiky do měnové unie nejprve z pohledu plnění tzv. Maastrichtských konvergenčních kriterií. Následuje návrh příslušných právních norem, které s přijetím společné měny souvisejí. Závěr diplomové práce obsahuje shrnutí hlavních poznatků včetně názorů autora na účast České republiky v hospodářské a měnové unii a na přijetí společné evropské měny euro.

Abstract:

ABSTRACT The thesis deals with the history, present and prospects of the economic and monetary union within the EU. In the First Chapter the penetration process of economic and monetary union in terms of economic order is characterized. Motives and causes that were leading to the initiation of the process of European integration are described first. In the next part of the chapter a description of the various integration levels, ie. free trade zone customs union, common market, economic and monetary union and political union, is given. Then, the fourth degree of integration ? economic and monetary union is described. The following section concerns the system of fixed rates and the consequent emergence of a common currency. The last part of the chapter provides a summary of the benefits and costs of a common currency. The Second Chapter of the thesis is devoted to the legal anchoring of European integration process. This section provides a chronological summary of all important legal documents ? the founding treaties, acts, plans and reports. In separated legal documents all selected key passages articulated in the text, are highlighted. In the Third Chapter of the thesis the economic and legal causes of the current crisis of the economic and monetary union, are analyzed. First, the chapter deals with the emergence of the financial crisis in the U.S. and then, showing the example of the Greek economy problems of the outstanding long-term public finances of European economies which have grown into the debt crisis, are discussed. The conclusion of the chapter contains the current state of the legal anchoring of the economic and monetary union. The Fourth Chapter of the thesis contains a description and assessment of possible measures in European and national legislation aimed at legal and economic stabilization of the economic and monetary union. Initially, this part of the thesis is focuses on necessary institutional and legislative changes. Within the legal enviroment of the European union with an emphasis on the preparation of the so-called ?Fiscal Compact?. This section of the chapter is followed by the proposal of legislative changes governing the state of public finances in the Czech Republic to the area of the proposed ?National financial constitution?. The last Fifth Chapter of the thesis is devoted to estimating the time horizon of entering the Czech Republic the monetary union first from the perspective of the fulfillment of the Maastricht convergence criteria. This section is followed by the proposal of relevent legal standards in relation with the adoption of a common currency. Finally, the last chapter of this thesis are those of the author on the Czech Republic's participation in the economic and monetary union and the adoption of the common European currency.
