Substitution in Law of Succession

Abstract:

Diplomová práce pojednává o substituci v dědickém právu. Shrnuje úpravu substitucí v právu římském a vysvětluje jednotlivé druhy substitucí v římském právu. Dále práce zkoumá vývoj substitucí v dědickém právu a vliv římského práva v novodobých kodifikacích. Práce pojednává o úpravě substituce v ABGB, dále v návrhu občanského zákoníku z roku 1937, občanského zákoníku z roku 1950 a 1964. V neposlední řadě podrobně rozebírá úpravu dědické substituce v občanském zákoníku účinném od 1. 1. 2014, tedy současnou právní úpravu.

Abstract:

The thesis deals with the substitution in law of succession. It summarizes legislation of substitution in Roman law and it explains individual types of substitution in Roman law. Than thesis researches the development of substitution in law of succession and the influence of Roman law in modern codifications. The thesis deals with the legislation in ABGB than in the bill of Civil Code of 1937, in the Civil Code of 1950 and 1964. Last but not least it dissects the legislation of substitution in the law of succession in the Civil Code effective from 1. 1. 2014, so the present legislation.
