Reconstruction of the Right to Life in the Context of the Development of Genetic Technologies (Philosophical and Legal Analysis of the Problem )

Abstract:

V této dizertační práci se zabýváme konstruktivní kritikou současné strategie ochrany práva na život. Naším záměrem je ukázat, že vlivem vzniku a použití biomedicínských technologií dochází k oslabení role státu jako ochránce práva na život. Tuto konstitutivní funkci státu postupně přebírají vědecká a zdravotnická zařízení, která jsou již schopna lidský život nejen uměle vytvářet, ale také určovat, zda a za jakých podmínek se bude biologicky a sociálně vyvíjet. Práce je rozdělena do osmi kapitol. V první kapitole vymezujeme filozofická východiska práva na život, jehož ochrana je hlavní funkcí a legitimizačním předpokladem vzniku státu. Na základě toho, jakým způsobem stát tuto funkci realizuje, ukazujeme na tendence, které umožňují postupnou privatizaci práva na život, čímž se jeho ochrana stává soukromou záležitostí jednotlivce. Za tímto účelem provádíme rekonstrukci toho, jak bylo právo na život postupně chráněno v mezinárodních a národních (ústavních) dokumentech. Další kapitola je věnována rizikům a problémům spojeným s rozvojem biomedicínských technologií, které se stávají novou technologií biomoci. Zaměřujeme se především na problematiku genetického inženýrství a asistované reprodukce. V této souvislosti se dále zabýváme kritickou analýzou právní regulace biomedicínských technologií, kterou konfrontujeme s morálním a právním statusem nenarozeného dítěte. Samostatná kapitola je věnována problematice náhradního mateřství a dárcovství pohlavních buněk. Tyto instituty považujeme za ukázku destruktivního působení biomedicíny, která mění dosavadní společenské a právní pojetí rodiny. Závěrem uvádíme metodická východiska právní ochrany lidského života v nových společensko-technologických podmínkách.

Abstract:

In this dissertation, we deal with the constructive criticism of the current strategy to protect the right to life. Our intent is to show how the creation and use of biomedicine technologies causes the role of a state as a defender of the right to life is weakened. This constitutive function of a state is gradually taken over by scientific and medical facilities, which are able to not just artificially create human life, but also to determine whether and under what conditions it will evolve biologically and socially. The thesis is divided into eight chapters. In the first chapter, we define the philosophical foundations of the right to life of which protection is the main function and the legitimization assumption for the establishment of a state. Based on the fact how the state implements this function, we show tendencies that allow the gradually privatization of the right to life, thus making its protection a private matter for individuals. For this purpose, we perform a reconstruction how the right to life was gradually protected in international and national (constitutional) documents. The next chapter is dedicated to the risks and problems connected with the development of biomedicine technologies that become a new technology of biopower. We focus especially on the issue of genetic engineering and assisted reproduction. In this context, we further deal with the critical analysis of the legal regulation of biomedicine technologies, which we confront with the moral and legal status of an unborn child. A separate chapter is devoted to the issue of surrogacy and germ cell donation. We consider these institutes to be an example of the destructive effects of biomedicine, which changes the existing social and legal concept of a family. In the end, we present methodological bases for the legal protection of human life in new socio-technological conditions.
