Liability in financial law

Abstract:

The diploma thesis deals with the legal regulation of liability in the financial law of the Czech Republic. The subject of the thesis is to describe the origin of legal liability, its elements, and consequences for failure to meet the primary obligations of legal norms of financial law. The main part of the thesis is focused on examples of the origin of legal liability and instruments of legal liability in the fiscal and non-fiscal part of financial law. Attention is paid first to the legal liability for violation of legal norms of financial law and then to the emergence of criminal liability related to financial law.

Abstract:

Diplomová práca sa zaoberá právnou úpravou zodpovednosti vo finančnom práve Českej republiky. Predmetom práce je popísať vznik právnej zodpovednosti, jej prvky a následky za nesplnenie primárnych povinností právnych noriem finančného práva. Hlavná časť diplomovej práce je zamarená na príklady vznik právnej zodpovednosti a nástrojov právnej zodpovednosti vo fiškálnej a nefiškálnej časti finančného práva. Pozornosť je kladená najprv na právnu zodpovednosť za porušenie právnych noriem finančného práva a následne na vznik trestnoprávnej zodpovednosti súvisiacej s finančným právom.
