Authorization Procedure according to the Excise Tax Act

Abstract:

Bakalářská práce se zabývá zákonem o spotřebních daních se zaměřením na povolovací řízení. Obecně charakterizuje aktuální právní úpravu zdanění se stručným popisem nejdůležitějších změn od účinnosti zákona č. 353/2003 Sb. Popisuje jednotlivé typy povolení vydávaných podle zákona o spotřebních daních se zaměřením na povolení, které je charakteristické pro režim podmíněného osvobození od daně. Analyzuje současnou právní úpravu z hlediska podmínek, které jsou stanoveny pro povolovací řízení a vyhodnocuje jejich pozitivní a negativní stránky s návrhem na možné změny v právní úpravě a doporučeními pro aplikační praxi. Následně podmínky stanovené de lege lata porovnává s podmínkami právní úpravy účinné do 31.12.2014 a vyhodnocuje jejich dopad na naplnění cíle správy daně.

Abstract:

The bachelor’s thesis deals with the Act on Excise Duty, with the focus on the authorization procedure. Thesis is focusing on the general characteriza-tion of the current tax legislation while briefly describing the most important changes following the coming into effect of the Act No. 353/2003 Coll. It describes the various types of permits, issued under the Act on Excise Duty, with the focus on characteristic permit of the suspension arrangement. The thesis analyzes the current legislation from the view of conditions assigned for permitting procedures and evaluates their positive and negative aspects while proposing possible changes in legislation and recommendations for application practice. The thesis then compares conditions assigned de lege lata with conditions legal regulation effective until 31.12.2014 and evaluates their impact on the fulfillment of the objective of the tax administration.
