The Position of Consumer in Relationship Containing an International Element.

Abstract:

Téměř každý člověk se v průběhu svého života ocitne v postavení spotřebitele. V době internetově provázaného světa, otevřených hranic a společného evropského trhu není výjimkou, když předmětný spotřebitelský vztah obsahuje relevantní mezinárodní prvek. Ve své diplomové práci v prvé řadě posuzuji nutnost zvláštní úpravy postavení spotřebitele ve vztazích s mezinárodním prvkem, a to zejména v procesu hledání a určování pravomocného orgánu, v procesu hledání a určování práva rozhodného a v procesu uznávání a výkonu rozhodnutí. Zjištěný závěr poté porovnávám se skutečností, především zda je stávající úprava nadbytečná či naopak nedostatečná, zda a kde způsobuje aplikační problémy a zda mezi jednotlivými procesními fázemi existuje provázanost nebo naopak nelogický rozpor. Zaměřuji se zvlášť na soudní řízení, rozhodčí řízení a projekt Ministerstva průmyslu a obchodu o mimosoudním řešení sporů. Součástí práce jsou také doporučení pro praxi s promítnutím úvah de lege ferenda.

Abstract:

Almost every person during his life finds himself in the position of a consumer. At the time of the internet coherent world, open borders and European Common Market it is not exceptional, if the consumer relationship in question contains a relevant international element. In my thesis I primarily assess the need for a special legislation for the position of consumer in relationship containing an international element, especially in the process of finding and determining the jurisdiction, finding and determining the applicable law and in the process of recognition and enforcement of judgment. Then I compare these findings with the reality, particularly whether the existing legislation is redundant, or insufficient, whether and where it is causing application problems and whether there is between individual process phases consistency or, conversely, logical contradiction. I focus separately on judicial proceedings, arbitral procedure and project of Ministry of Industry and Trade about alternative dispute resolution. Parts of this thesis are also recommendations for practice, reflecting the consideration de lege ferenda.
