Provision of contractual relations

Abstract:

Bachelor thesis deals with providing contractual legal relations and legislation. The first chapter focuses on the theoretical background related to the topic of the thesis. The second chapter consists of the characterization of selected security funds through the Commercial Code and the Civil Code. In the third chapter we approach the use of hedging instruments on the ground and through comparisons point out the extent of their use. The result is a demonstration of the importance of the use of hedging instruments: liability, security transfer of rights and contractual penalty in practice and addressing their regulation by the Commercial and Civil Code.

Abstract:

Bakalárska práca sa zaoberá zabezpečením záväzkových právnych vzťahov a ich právnou úpravou. Prvá kapitola je zameraná na teoretické východiská súvisiace s témou bakalárskej práce. Druhá kapitola pozostáva z charakterizovania vybraných zabezpečovacích prostriedkov prostredníctvom Obchodného zákonník a Občianskeho zákonníka. V tretej kapitole priblížime používanie zabezpečovacích prostriedkov v praxi a prostredníctvom komparácie poukážeme na mieru ich využívania. Výsledkom práce je poukázanie na význam využívania zabezpečovacích prostriedkov: ručenie, zabezpečovací prevod práv a zmluvná pokuta v praxi a poukázanie na ich právnu úpravu podľa Obchodného a podľa Občianskeho zákonníka.
