Legal Regulation of Acquisition and Disposal of Real Estate by Road and Motorway Directorate of the Czech Republic

Abstract:

Náplní bakalářská práce je poukázání na právní normy a jejich jednotlivé ustanovení, které se týkají majetkoprávní přípravy a vypořádání nemovitých věcí v působnosti Ředitelství silnic a dálnic ČR. Cílem je seznámit čtenáře se základními způsoby, jejich odlišnostmi a postupy. V první části je to nabývání majetku, ať již dobrovolné nebo z rozhodnutí státního orgánu. Druhá část je zaměřena na převod příslušnosti hospodařit úplatně i bezúplatně. V třetí kapitole se zaměřím na nakládání formou zatížení pozemků, různé způsoby nakládání s nepotřebným majetkem nebo jiné formy nakládání. V závěru se zabývám návrhy na změny právních předpisů a analyzuji nedostatky s několika návrhy de lege ferenda.

Abstract:

The aim of this bachelor thesis is the description of legal regulations that deal with property rights of public utility buildings and different methods of real estate settlement. The goal of this bachelor thesis is to introduce the main procedures of real estate settlement used by the Road and Motorway Directorate of the Czech Republic. The first part of this thesis focuses on the acquisition of property rights. The acquisitions can vary from voluntary acquisitions to involuntary expropriations. The next part concerns the issue of gratuitous and chargeable transfers of the managing rights. The third part analyses the execution of managing rights in the form of encumbrances and different ways of managing unneeded property. The last part deals with the analysis of current proposed amendments to the legal regulation of this field. This thesis reflects the imperfections of present legal regulation from „de lege ferenda“ point of view.
