Abstract:

Práce se zabývá kvalifikovaným posouzením jednání daových subjekt z hlediska komparace s trestním právem, které ovlivuje zejména plnní oznamovací povinnosti správc dan. Toto posouzeni prohlubuje znalosti v oblasti finanního a daového práva, orgán inných v trestním ízení, což má za následek odstranní nedostatk pi posuzování znak skutkové podstaty trestného inu zkrácení dan, poplatku a podobné povinné platby. Rozborem podstaty a pachatele trestných in krácení daní a poplatk, specifikací možností daových únik, metod jejich vyhledávání a souasn nástinem postup jejich dokazování v daovém ízení za dodržení základních zásad daového i správního ízení je sledován cíl zlepšení vyhledání a sankních opatení vi pachatelm a subjektm, kteí se dopustili krácení daní a poplatk. Tento rozbor je obsažen v jednotlivých kapitolách práce s tžištm na vlastní daové úniky a vývoj smr krácení daní a poplatk. V dsledku stále se prohlubující globalizace, vytvoení jednotných mezinárodních trh, vniku nadnárodních koncern a seskupení se rozsah innosti daových poplatník mní a finanní úady jednotlivých zemí se proto snaží pizpsobit své prostedky šetení novým možnostem daových únik. Nestaí již pouze šetení a vyhledávání daových únik zamit pouze na sledování uritého teritoria správními orgány, ale pi odhalování tchto závažných delikt je poteba mezinárodní spolupráce. Postupným vývojem se pesouvá tžišt závažné trestné innosti daleko strmji od oblasti pímých daní do oblasti daní nepímých. Lze to zdvodnit zejména fiskálními dvody a to velkým objemem finanních prostedk. Jakékoliv snížení daové povinnosti, resp. její zatajení v oblasti nepímých daní se z hlediska struktury daové soustavy projeví i v odvodu daní pímých. Souasn s rozšíením tržního prostoru vstupem R do evropského spoleenství došlo i k uritému posunu v oblasti daových únik do sféry mezinárodní a o to spoleensky nebezpenjší a obtížnji zjistitelných. Metody a prostedky vyhledávání daových únik jsou podstatou další ásti práce. Analýza a definice daových únik jak z hlediska správy daní tak i možnosti posouzení z hlediska trestního práva, by podle mého názoru, nebyla úplná bez specifikace metod a postup jejích odhalování. Pi vyhledávání daových únik a jejich dokazování je nutné postupovat v souladu se základními zásadami správního, daového a trestního ízení. Srovnáním tchto zásad a procesních postup, jejich uplatnním v praxi u finanních úad, ostatních správc dan i orgán inných v trestním ízení, lze dosáhnout úinnjšího potírání daových únik. Toto srovnání se mi jeví jako úelné k získání všeobecného nadhledu úzce specializovaných pracovník správy daní a orgán inných v trestním ízení. Tyto obecné analýzy a specifikace jsem v této práci upednostnil ped praktickými píklady krácení daní. Pro úplnost postup a zásad ízení jsou v závrené ásti práce rozebrány vybrané zásady správního a daového ízení a problémy s dokazováním v daovém ízení Závrem práce je provedeno struné shrnutí a úvahy de lege lata a de lege ferenda o souasném stavu v oblasti daových únik z hlediska jak trestní odpovdnosti tak i z pohled správc dan vetn možných ešení nedostatk a posouzení úinnosti již pijatých opatení

Abstract:

Tax Fraud, its search, claiming in the Tax system and comparison with Criminal Law in the region of identification and prosecution Tax fraud is one of the most common criminal offences causing great financial damage to the State. According to the second special part of the Criminal Law, legislation relating to tax fraud is the most frequently represented group of the economic criminal acts. Nearly every inhabitant and all corporations are subject to tax and associated duties. This paper is a qualified assessment of the activities of tax subjects. This is from the point of view of comparison with the Criminal Law, affecting mainly the fulfilment of the reporting duties of the Tax administrators. This assessment extends the knowledge in the field of fiscal and tax law of the organs active in the criminal proceedings. This results in removal of shortcomings during the claiming of the legal sign of the facts of the case mainly of the criminal acts of curtailment of taxes, fees and similar compulsory payments. The basic rules of tax and administrative proceedings are aimed to improve the claiming and sanction provision towards the perpetrators and subjects who committed curtailment of taxes and fees. This also includes analysis of the essence and perpetrator of the criminal acts of curtailment of taxes and fees, specification of the possibilities of the tax evasion, the methods of their search and simultaneously the outline of the method of their claiming in the tax proceedings. This analysis is contained in the individual chapters of the Paper with the accent on actual tax avoidance and the development of trends in the avoidance of taxes and fees. The range of the taxpayers activities is changing as a result of ever deepening globalisation, the creation of the unified international markets, penetration of the multinational syndicates and groups. Therefore the revenue offices of the individual countries endeavour to adapt their means of investigation to the new possibilities of tax evasion. It is no longer sufficient to focus the investigation and search of tax evasion by the administrative organisations within a certain territory but international co-operation is required during the disclosure of the criminal acts. Through a gradual development the focus of these grave criminal activities has shifted from direct taxes to indirect taxes. This could be substantiated mainly by the fiscal reasons involving a large amount of financial means. Any tax duty cuts or tax concealment in the area of indirect taxes will have repercussions in the revenue of direct taxes. Following the enlargement of the market space in connection with the entry of the Czech Republic to the European Union, a certain shift has taken place in the area of tax avoidance to the international sphere. It is therefore becoming more difficult to identify and this represents a greater danger to society. The following part of the paper deals mainly with the methods and means of the search of tax avoidance. The analysis and definition of tax avoidance from the point of view of tax control, and possibilities of consideration from the point of view of Criminal Law, wouldnt be, in my opinion, complete without specification of the methods and procedures of their disclosure. It is necessary to follow the fundamental regulations of management, tax and criminal proceedings during the search and claiming of tax avoidance. Through the comparison of these codes and lawsuit procedures, their invocation in practice by the revenue offices, other tax managers and government organisations active in the criminal proceedings, a more effective removal of tax evasion can be achieved. I consider this comparison useful to obtain an overall view of the strictly specialized tax management staff and government organisations active in criminal proceedings. ails of the methods and principles of management, selected principles of management and tax proceedings and problems connected with the claiming in tax proceedings, are dealt with in the final part of the Paper. The closing part of the paper contains a brief summary and essays de lege lata and de lege ferenda about the present situation in the area of tax evasion from the point of view of both penal responsibility and tax managers. It also includes possible remedial actions and review of the effect of the legal measures in force.
