Abstract:
Práce se zabývá únikovou doložkou v mezinárodním právu soukromém. Úniková doložka je nejprve rozebrána z teoretického hlediska, následně se práce zabývá možnostmi aplikace únikové doložky. V souvislosti s únikovou doložkou práce pojednává také o vztahu mezi principy právní jistoty a flexibility a promítá tato obecná východiska do hodnocení únikové doložky. The thesis deals with escape clause in private international law. Firstly, the escape clause is examined from theoretical point of view, then the thesis examines possible methods of application of the escape clause.
