Unfair plotting in public procurement and public sale

Abstract:

The aim of this work is to highlight the issue of machinations in public procurement and public auction, which currently represents a significant problem for society. The first chapter focuses on economic crimes, which are the constituent elements of criminal acts against the market economy and economic discipline. This chapter focuses also on the protection of the market economy in Slovakia and on the importance of this protection. The second chapter describes options of how to protect the market economy and provides basic information on public procurement and public auction, which are related to administrative offenses of unlawful conduct outside the criminal justice system. The third chapter discusses crime machinations in public procurement and public auction mentioned offenses that may be associated with these crimes, it outlines the procedure for law enforcement agencies and courts, and provides recommendations on how to fight corruption and cartels in public procurement and public by auction.

Abstract:

Cieľom bakalárskej práce je poukázať na problematiku machinácií pri verejnom obstarávaní a verejnej dražbe, čo súčasnosti predstavuje pre spoločnosť podstatný problém. Prvá kapitola je zameraná na hospodárske trestné činy, v ktorých sú uvedené skutkové podstaty trestných činov proti trhovej ekonomike a hospodárskej disciplíne. Táto kapitola je tiež zameraná ochranu trhovej ekonomiky na Slovensku význam tejto ochrany. Druhá kapitola je zameraná na spôsob ochrany trhovej ekonomiky a poskytuje základné informácie o verejnom obstarávaní a verejnej dražbe, čím súvisia aj správne delikty protiprávneho konania mimo systém trestného práva. Tretia kapitola rozoberá trestný čin machinácií pri verejnom obstarávaní a verejnej dražbe, spomína trestné činy, ktoré môžu súvisieť s týmto trestným činom, stručne popisuje postup orgánov činných v trestnom konaní a súdov a poskytuje odporúčania ako bojovať proti korupcii a kartelovým dohodám vo verejnom obstarávaní a verejnej dražbe.
