Abstract:

Tato rigorózní práce se věnuje studiu a zpracování problematiky kuplířství ze dvou pohledů – kriminologického a hmotněprávního. Tomu také odpovídá struktura práce, která se v podstatě dělí na dvě části, a to na část kriminologickou (kapitola 2) a hmotněprávní (kapitoly 3 a 4). První část si klade za cíl popsat deliktní jev kuplířství, jeho podobu, formy a fenomenologii, stejně jako delikventa a jeho modus operandi. Druhá část si klade za cíl poskytnout první rozšířený výklad o znacích základních skutkových podstat trestného činu kuplířství podle § 189 odst. 1 tr. zákoníku, především znaku „kořistění“ a jeho limitů. Hmotněprávní část se také věnuje problematice projevů zásady subsidiarity trestní represe u vybraných typů trestněprávně relevantních jednání, které mohou indikovat sníženou společenskou škodlivost činu. Závěrem práce nabízí i návrhy de lege ferenda.

Abstract:

This thesis is devoted to the study and description of procuring from two perspectives – criminological and substantive legal. This also corresponds to the structure of the thesis, which is basically divided into two parts, the criminological part (chapter 2) and the substantive legal part (chapters 3 and 4). The first part aims to describe the offence of procuring, its nature, forms and phenomenology, as well as the delinquent and their modus operandi. The second part aims to provide the first extended interpretation of the elements of the offence of procuring according to Article 189(1) of the Criminal Code, especially the element of "exploitation" and its limits. The substantive legal part also addresses the issue of the manifestation of the principle of subsidiarity of criminal repression in selected types of criminally relevant conduct that may indicate a reduced social harmfulness of the conduct. Finally, the thesis offers de lege ferenda suggestions.
