Anotácia:

Bakalářská práce se zabývá řešením mezinárodních sporů z investic. Teoretická část je tvořena definováním pojmu investice a pojmu investor. V druhé části je charakterizována ochrana investic, s níž souvisejí dohody o podpoře a ochraně investic – dvoustranné smlouvy (BIT) a mnohostranné smlouvy o ochraně investic (např. Washingtonská úmluva, Soulská úmluva a TRIMS), dále jsou uvedeny platné dohody a protokoly k dohodám o ochraně investic ČR – jedná se o přehled dohod, které již byly ukončeny nebo se u nich plánuje ukončení, a souhrn neboli přehled zemí, se kterými má ČR uzavřenou platnou dohodu o podpoře a vzájemné ochraně investic. Třetí část charakterizuje mezinárodní spory z investic. Mezi nejvýznamnější patří spory mezi smluvním státem a investorem a spory mezi smluvními státy. Poslední teoretická část bakalářské práce se zabývá řešením sporů. Mezi nejvýznamnější a nejpoužívanější patří řešení sporů stálým rozhodčím soudem, řešení sporů rozhodčím soudem ad hoc a řešení sporů střediskem ICSID.

Abstract:

Summary This thesis deals with the solution of international disputes on investment. The theoretical part it is formed by defining the concept of investment and investor concept. The second part characterizes investment protection with which related agreements on the promotion and protection of investments - a bilateral treaty (BIT), a multilateral agreement on investment protection (eg. Washington Convention, the Seoul Convention and TRIMS), then there are valid agreements and protocols to agreements. Investment Protection Czech Republic - this is a summary of agreements which are preparing termination or which have already been completed, and a list of countries with which the CR has concluded a valid agreement on encouragement and reciprocal protection of investments. The third part describes the international investment disputes, among the most important disputes between the State Party and an investor and disputes between Contracting States. The last part of the thesis characterizes dispute resolution. The most important and most frequently used include resolving disputes permanent
