The Discretion in the Aliens Law

Abstract:

Tato diplomová práce se zabývá problematikou správního uvážení v cizineckém právu. Oba instituty jsou nejprve popsány v rovině teoretické. Stěžejní část práce je zaměřena na popis a analýzu správního uvážení v jednotlivých ustanoveních cizineckého práva se zaměřením na řízení o udělení humanitárního azylu, řízení o vydání dlouhodobého víza a řízení o vydání povolení k trvalému pobytu. Práce se zaměřuje na zhodnocení zákonných ustanovení a aplikační praxe, snaží se vymezit klady a zápory správního uvážení v cizineckém právu a navrhnout možná řešení.

Abstract:

This diploma thesis deals with the issue of discretion in the Aliens Law. Both institutes are at first described at the theoretical level. The main part is focused on the description and analysis of the Discretion in individual provisions of the Aliens law with a focus on the procedure for granting humanitarian asylum, extradition proceedings and managing long-term visa for the issue of a permanent residence permit. The work focuses on the evaluation of the application of legal provisions and practice, trying to determine the pros and cons of administrative discretion in the Aliens Law, and propose possible solutions.
