Abstract:

Tato diplomová práce vymezuje obecné zásady práva Evropské unie jako jeden z pramenů práva EU, a to jak z hlediska teoretického, tak i s ohledem na praktické příklady z judikatury Soudního dvora Evropské unie. V práci jsou též nastíněny některé problémy a otázky vyplývající z kreativní role Soudního dvora při formulaci a aplikaci obecných zásad práva EU. V tomto směru jsou v práci rozebrány tři hlavní otázky: co to jsou obecné zásady práva EU, jaké jsou jejich zdroje a jaké je jejich postavení a role v právu EU.

Abstract:

This thesis deals with the general principles of European Union law as one of the sources of EU law, both in terms of theory and with regard to practical examples found in the case law of the Court of Justice of the European Union. The thesis also outlines some issues and questions arising from the creative role of the Court of Justice in the formulation and application of the general principles of EU law. Three main topics are covered in this regard: what are the general principles of EU law, what are their sources and what is their position and role in the EU law.
