European Arrest Warrant and the Rule of Law Crisis: Is the Principle of Mutual Trust Still Alive?

Abstract:

Tato bakalářská práce zkoumá princip vzájemné důvěry mezi členskými státy Evropské unie a jak tento princip souvisí s hodnotami právního státu. Jádrem práce je analýza pěti rozhodnutí Soudního dvoru Evropské unie, která jsou v práci prezentována v chronologickém pořadí. Analýza rozhodnutí ukazuje důležitost principu vzájemné důvěry a jak je tento princip promítnut ve zmíněných pěti rozhodnutích týkajících se výkonu evropského zatýkacího rozkazu. Tato práce také poskytuje odpověď na otázku, zda je princip vzájemné důvěry stále funkční.

Abstract:

This bachelor's thesis scrutinizes the principle of mutual trust among member states of the European Union and the affect the principle of mutual trust has on the rule of law. The core of this thesis is the analysis of five judgments of Court of Justice of the European Union, which will be presented in chronological order. The analysis of the five judgments shows the importance of the principle of mutual trust and how is this principle reflected in the judgments. Furthermore, it answers the question whether the principle of mutual trust is still alive.
