Legal acts in providing health care with regard to donation and transplantation of tissues and organs

Abstract:

Poskytování zdravotní péče velmi úzce souvisí s otázkou základních lidských práv a proto je kromě vnitrostátní úpravy i předmětem celé řady mezinárodních úmluv a paktů o lidských právech. Jako nejvýznamnější dokument, který se věnuje lidským právům v oblasti zdravotnictví lze v současné době označit Úmluvu na ochranu lidských práv a důstojnosti lidské bytosti v souvislosti s aplikací biologie a medicíny, jejímž hlavním posláním je zaručení lidské důstojnosti, základních práv a svobod všech osob při umožnění dalšího pokroku na poli medicíny a biologie. Úmluva se věnuje všem důležitým prvkům poskytování zdravotní péče od povinnosti zajištění rovné dostupnosti zdravotní péče přes povinnost provádět jakýkoliv zákrok pouze v souladu s profesními standardy, nezbytnost svobodného a infomovaného souhlasu, respektování dříve vyslovených přání až po vědecký výzkum. Vzhledem ke skutečnosti, že Úmluva byla Českou republikou přijata, má dle čl. 10 Ústavy přednost před běžnými zákony a je přímo aplikovatelná. Stěžejní vnitrostátní právní předpis představuje zákon č. 20/1966 Sb., o péči o zdraví lidu. Tato právní norma, která po desetiletí upravuje poskytování zdravotní péče, byla zejména v posledních deseti letech opětovně novelizována tak, aby reflektovala na realitu. Hlavní změny postihují nejenom právní úpravu nově prováděných úkonů, ale hlavně směřují právní úpravu směrem k moderním pojetím vztahu pacienta a lékaře. To se týká zejména pohledu na pacienta jako rovnocenného partnera a také většího důrazu na pacientovu vůli. Přes všechny tyto snahy by však dle mého názoru mohla jít právní úprava dále, zavedením některých institutů, jakým je například institut respektování dříve vyslovených přání. Stejně tak současná legislativa nedefinuje standard v poskytování zdravotní péče, což prakticky neumožňuje financování zdravotní péče ze soukromých zdrojů. Je to právě oblast organizace poskytování zdravotní péče, která nutně potřebuje kompletní změny právní úpravy. Různé subjekty poskytující zdravotní péči jsou upraveny různými zákony a právní úprava je tak roztříštěná a nepřehledná. Hlavním nešvarem však je ta skutečnost, že celkově právní úprava nevyhovuje požadavkům současné reality, což je patrné zejména pokud jde dokonce o právní formu některých poskytovatelů zdravotní péče. Kapitola věnující se právní úpravě transplantací nebyla zvolena náhodně. Důvodem pro výběr právě tohoto tématu byla kromě jeho aktuálnosti jak medicínské tak právní i skutečnost, že oproti obecné právní úpravě poskytování zdravotní péče, představuje právní úprava transplantací moderní, jasnou a přehlednou právní úpravu zahrnující všechny důležité prvky darování a transplantací. Přestože Českou republikou nebyl ratifikován Dodatkový protokol k Úmluvě na ochranu lidských práv a důstojnosti lidské bytosti v souvislosti s aplikací biologie a medicíny o transplantaci orgánů a tkání lidského původu, tak jeho hlavní podstata je zakotvena v zákoně č. 285/2002 Sb. o darování, odběrech a transplantacích tkání a orgánů. Základními principy, o které se zákon opírá, jsou předpokládaný souhlas s posmrtným odběrem tkání a orgánů (tedy tzv. princip opting-out), spravedlnost při alokaci tkání a orgánů, povinná registrace osob čekajících na transplantaci, dárců a příjemců tkání a orgánů. Rovněž je zde zakotveno pravidlo zákazu finančního prospěchu či jiných výhod v souvislosti s odběrem a transplantací orgánů a tkání. utkové podstaty: neoprávněné odebrání tkání a orgánů, nedovolené nakládání s tkáněmi a orgány a odběr tkáně, orgánu a provedení transplantace za úplatu. Pokud se týká možného vývoje právní úpravy transplantací, tak se dá předpokládat, že dojde ke změně v tom smyslu, že bude možné odebrat tkáň nebo orgán od cizince zemřelého v České republice. Touto změnou by mělo dojít k narovnání stavu, kdy občanům České republiky, zemřelým v cizím státě, může být v závislosti na tamější právní úpravě tkáň nebo orgán odebrán. Další změnou, která stojí dle mého názoru za zvážení, je zavedení legální kompenzace dárcům například ve formě slev na dani, příspěvků na lázeňskou péči atd.

Abstract:

Providing health care is closely linked to fundamental human rights. Therefore, in addition to national legislation, providing health care is an important subject to a number of international conventions and treaties on human rights. As the most important document, which focuses on human rights in the area of health care, we can now mark 'The Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine'(Convention on Human Rights and Biomedicine), whose main aim is to guarantee human dignity, fundamental human rights and freedoms of every person and allowing further progress in medicine and biology at the same time. The Convention engages all the important elements of providing health care from the obligation to ensure equal access to health care through the obligation to perform any medical intervention in accordance with professional standards, the need for free and informed consent, respect for the previously expressed wishes (living will), to the scientific research. As a result of the adoption of the Convention by the Czech Republic, the Convention has according to Article 10 of the Constitution higher legal force than national laws and is directly applicable. Act No. 20/1966 on Health Care represents basic Czech law regulating provision of health care. This legal norm, which has regulated the provision of health care for decades, has been re-amended especially in the last ten years to reflect the reality. The main changes affect not only the regulation of new medical interventions, but are mainly directed to approximation of the legislation and modern concepts of a doctor-patient relationship. This applies especially to the view of a patient as an equal partner and also to a greater emphasis on the patient's will. Despite all these efforts, in my view, the legislation could go further by introducing some institutes, such as 'The Institute of Respect for Previously Expressed Wishes'. Likewise, current legislation does not define standards in health care, which practically makes the financing of health care by private sources impossible. It is especially the area of health care organization, which desperately needs a complete change in legislation. Various entities providing health care are governed by different laws and law regulation is so fragmented and confused. But the main problem is that generally the legislation does not answer the needs of the current reality, which is particularly apparent in the question of the legal forms of certain health care providers. The Chapter dealing with the regulation of transplantation was not selected by accident. The reason for the choice of exactly this issue was, apart from its both medical and legal attractiveness, the fact, that in comparison to the general regulation of health care legislation, it represents the legal regulation of transplantations with a modern, clear and transparent regulation covering all the important elements of the donation and transplantation. Although the Czech Republic has not ratified the Additional Protocol to the Convention on Human Rights and Biomedicine on Transplantation of Organs and Tissues of Human Origin, its main principles are adopted in Act no. 285/2002 on Donation, Collection and Transplantation of Tissue and Organs and in a change of several acts (the Transplantation act). The basic principles on which the Act is based, are these: implied consent to post-mortal collection of tissues and organs (i.e. the opting-out principle), justified allocation of tissues and organs, the compulsory registration of persons waiting for transplantation, donors and recipients. The human body and its parts shall not, as such, give rise to financial gain or comparable advantage. In this context, it is necessary to mention the new Criminal Code, which regulates the area of transplantation from the view of criminal law. d collection of tissues and organs, illegal handling with tissues and organs and collection of a tissue or an organ or performance of a transplantation for a financial consideration. Regarding the possible development of the transplantation law, I think, that the legislation will enable collection of a tissue or an organ from a foreigner deceased in the Czech Republic. This change should compensate for the fact, that citizens of the Czech Republic, who die in a foreign country can under certain circumstances become donors of tissues and organs. Another change, which in my opinion is worth considering is the introduction of legal compensation for donors, for example in the form of tax relief, contributions to a spa treatment, etc.
