Current trends in the field of challenging tax evasion at the EU level with a focus on the ATAD directive and its implementation into Czech legislation

Abstract:

Bakalářská práce se zbývá tématikou agresivního daňového plánování na úrovni EU. V teoretické části práce je nejdříve stručně sepsán úvod do problematiky, který pojednává o vývoji jednotlivých inciativ v boji proti agresivnímu daňovému plánování na úrovní EU nebo OECD. V této části je také mírně představen projekt BEPS, z kterého částečně čerpala EU při představení vlastních pravidel. Následně se teoretická práce zabývá, již samotným představením směrnice ATAD, u které je kladen důraz na vysvětlení a představení všech zaváděných pravidel. V návaznosti na směrnici ATAD je v závěru teoretické části představena forma, jakou se tato směrnice implementovala do české daňové legislativy. V této kapitole jsou představeny jednotlivá pravidla s odkazy na ustanovení, která je v České republice upravují. V praktické části je analyzován dopad nově implementovaného pravidla pro omezení odpočitatelnosti úroků na české daňové subjekty. Pro tuto analýzu byly vybrány 3 společnosti, které byly podrobeny výpočtu na reálných datech. Výsledkem je poté snaha o zobecnění závěru, na jaké tuzemské daňové poplatníky se bude nové pravidlo vztahovat.

Abstract:

The bachelor's thesis discusses the topic of aggressive tax planning at the EU level. The theoretical part of the thesis first briefly introduces the topic of development of individual initiatives in the fight against aggressive tax planning at the EU or OECD level. Furthermore, this section also slightly discusses the BEPS project, from which the EU drew in part when developing its own rules. Subsequently, the theoretical part of the thesis deals with the very introduction of the ATAD directive, in which emphasis is placed on the explanation and presentation of all introduced rules. Following the ATAD directive, the form in which this directive has been implemented into Czech tax legislation is presented at the very end of the theoretical part. The practical part of the thesis analyses the impact of the newly implemented Interest limitation rule on Czech tax entities. For this analysis, 3 companies were selected, which were subjected to calculations on real data. The result is then an attempt to generalize the conclusion on which domestic taxpayers the new rule will apply.
