The Family Trusts (Fideicommissum) of the Czech Aristocracy. The Case of the Fideicommissum over the Family Schlik Property in Kopidlno and Staré Hrady

Abstract:

Šlechtický rod hrabat Schliků, původem ze západních Čech, začal budovat po 30. leté válce svoji budoucí doménu ve východních Čechách. Nové panství se rozkládalo v okolí Jičína. Centrem panství byly města a statky Kopidlno, Staré Hrady a Vokšice. V roce 1672 v souladu s tehdy běžnými trendy zavedl František Arnošt Schlik na ochranu svého majetku rodinného fideikomisu. Právní institut, který přišel s dynastií Habsburků ze Španělska brzo v Čechách zdomácněl. Jeho podstata spočívala ve vybudování svěřenství pro určitý majetek s nadefinovaným okruhem nástupců. Součástí testamentu byla řada podmínek, které musel držitel fideikomisu plnit (posloupnost v mužské linii, zákaz mesaliance, katolická víra apod.). František Arnošt Schlik ustanovil původně fideikomis pro veškeré statky, ale po jeho smrti půl panství (Vokšice, Bartošov, Jičíněves) z fideikomisu vydělili. Až do zrušení fideikomisu v roce 1924 vedle sebe existovaly dvě panství Kopidlno - Staré Hrady a Vokšice - Jičíněves. V roce 1906 zemřel poslední držitel fideikomisu Ervin Schlik bez potomků. Jeho bratr František žil v nerovnorodém manželství. O nástupnictví se přihlásili vzdálení příbuzní Ungnadové z Weissenwolfu, kteří v soudním procesu nástupnictví ve fideikomisu v roce 1912 získaly. Rod Weissenwolffů vymřel v mužské linii v roce 1917. František Schlik a jeho syn Jindřich Schlik se pokusili opět do nástupnictví přihlásit. V průběhu řízení skončila monarchie a vznikla demokratická republika. V novém řízení začala platit nová pravidla a k vyloučení z nástupnictví ve fideikomisu se již nepřihlíželo. Přesto se Schlikům opakovaně nepodařilo bývalé majetky získat zpět. Práce se soustředí na rozhodovací praxi soudů v období rakousko-uherské monarchie a v období československé republiky.

Abstract:

The aristocratic family of the Counts of Schlik originates from Western Bohemia. After 1648, Heinrich Schlik began to build its family new future domain in Eastern Bohemia. The new estates were located around the town of Jičín. The center of the manor were the towns and estates of Kopidlno, Staré Hrady and Vokšice. In 1672, in accordance with the common trends, Franz Ernst Schlik introduced a trust to protect his immovable property. The legal institute of a trust came to the Czech Lands with the Habsburg dynasty from Spain (mayorazdos, mayoradgos) and it soon became popular by the Bohemian and Moravian noble families. The main principles of the trust consisted of the creation of the fideicommissum familiae perpetuum for a certain property with a defined circle of the successors. The trust was often founded by a testament and contained a number of conditions for the legitimate holders of the trust (hereditary succession in the male line, the prohibition of the unequal marriages, Catholic faith etc.). Franz Ernst Schlik originally established a trust for all his estates, but after his death half the estates (Vokšice, Bartošov, Jičíněves) were separated from the trust to the free property of the Counts of Schlik. Until the abolition of the trusts in the Czech legal culture in 1924, there were two manors: Kopidlno - Staré Hrady as a trust and Vokšice - Jičíněves as a free property. In 1906, Erwein Schlik, the last holder of the Kopidlno - Staré Hrady trust, died without descendants. His brother Franz lived in an unequal marriage from the view of Austro-Hungarian Courts. The family of the Ungnads of Weissenwolf, a distant relatives, applied for succession in agreement with the testament of 1672. In 1912, they obtained succession in the trust in a trial. In 1917, the Weissenwolff family male line died out. In 1918 the Czechoslovak Republic and the parliamentary democracy were established. Franz Schlik and his son Heinrich Schlik tried to obtain the succession in the trust back, because they believed in the change of the rules in the democratic state. Under the new circumstances, the unequal marriage was no longer taken into consideration as a reason for the exclusion from succession. Nevertheless, the Counts of Schlik repeatedly failed to recover the former family property due to the reluctance of the courts to open the case in the merits. The work focuses on the development of the Kopidlno - Staré Hrady trust and the changes in the judicial decision-making practices in the period of the Austro-Hungarian monarchy and the Czechoslovak Republic respectively.
