Legal Aspects of Trading Foreign Persons

Abstract:

Tato bakalářská práce se zabývá popisem a analýzou právních aspektů živnostenského podnikání zahraničních osob. Na začátku práce je rozebrán pojem živnostenského podnikání a jeho charakteristika, následující kapitola popisuje historický vývoj přístupového režimu k živnostenským oprávněním. Další kapitoly se snaží vysvětlit základní instituty živnostenského zákona ve vztahu k zahraničním osobám. Stěžejní část je věnována vzniku, změně a zániku živnostenského oprávnění se zaměřením na rozdílné postavení zahraničních osob, zejména osob ze třetích zemí.

Abstract:

This bachelor thesis deals with the description and analysis of legal aspects of trading foreign persons. At the beginning of the thesis the concept of trading and its characteristics according to the Trade Licensing Act is analyzed, followed by a chapter describing the historical development of the regulatory access regime to the Trade license. Next chapters tries to explain the basic institutes of the Trade Licensing Act in relation to foreign persons. The crucial part is dedicated to the Trade authorization and its establishment, amendment and termination and focusing on the differences of status of foreign persons, especially persons from third countries.
