Abstract:

Cílem diplomové práce je přiblížit problematiku vztahující se k pojmu kvalifikace zaměstnance. Autor se v diplomové práci věnuje zejména vymezení tohoto pojmu a pojmů souvisejících. Vychází přitom z dostupné literatury, soudních rozhodnutí a v neposlední řadě z vnitrostátních, mezinárodních a komunitárních právních předpisů. Snahou autora je zanechat v čtenáři fakt, že kvalifikace zaměstnance je velice důležitým institutem pracovního práva, zvláště pak na poli trhu práce. Struktura diplomové práce je tvořena devíti kapitolami, když první z nich je stručný úvod. Druhou kapitolou je právo na práci jako jedno ze základních lidských práv a svobod a jeho zakotvení v právních předpisech té nejvyšší síly. Třetí kapitola je pak dle autora stěžejní, neboť popisuje vymezení pojmu kvalifikace zaměstnance, její zvyšování, prohlubování a možnost uzavření kvalifikační dohody. Čtvrtá z kapitol se věnuje vlivu kvalifikace zaměstnance na výši finančního ohodnocení zaměstnance. Pátá kapitola popisuje uznávání kvalifikace z obecného pohledu a člení toto uznávání na akademické a profesní. Šestá kapitola zahrnuje současnou platnou komunitární úpravu na poli Evropské unie. Sedmá kapitola se zabývá uznáváním kvalifikace na poli prává mezinárodního. Osmá kapitola pak pouze zmiňuje hlavní vnitrostátní předpis upravující uznávání kvalifikace z pohledu České republiky. Následná, devátá kapitola, je závěr celé diplomové práce. Po uvedených devíti kapitolách následuje cizojazyčné resumé, seznam použité literatury a příloha č. I diplomové práce.

Abstract:

The graduation theses tries to describe the issue concerning the term Qualification of the employee. The Author makes an effort to allocate this term and the terms related in the graduation theses. He stems from the literature available for this topic, adjudications and last but not least the national, international and european legal acts at the same time. The author´s effort is to leave in the reader the fact that the qualification of the employee is a very important institute of the industrial law, especially on the employment market´s field. The structure of the graduation theses is organized into nine Chapters, while the first of them is a short introduction. The right to work, as one of the basic human rights and liberties and its grounding in the legal acts of the supreme power is described in the Chapter II. The Chapter III is according to the author one of the most important ones, because it describes the definition of the term the Qualification of the employee, its increase, upgrade and the opportunity to obtain qualification deals. The Chapter IV is concerned with the influence of the employees´ qualifications on the level of their finacial valuation. The Chapter V describes the recognition of qualifications from the general point of view and distinguishes between the academic and the profession recognition. The Chapter VI contains the actual valid european adaptation on the European Union´s field. The Chapter VII is concerned with the recognition of qualifications on the field of international law. The Chapter VIII mentions the main national prescript adapting the recognition of qualification from the Czech Republic point of view. The following Chapter IX is the Resumè of the graduation theses. After the nine Chapters mentioned, the graduation theses continues with the foreign-language Resumè, the literature list and the attachment No. I of the graduation theses.
