Return policy of Spain in relation to Ceuta

Abstract:

Migrace do Evropy má dlouhodobou historii, která zahrnuje velkou kapitolu o iregulární migraci z afrických zemí na evropský kontinent. Imigrace, jako jedná z naléhavých témat, byla vždy přijata různě a mezi úkoly dané práce patří na příkladě jedné z aktuálních migračních cest, přes Ceutu, zjistit, jak Španělsko řídí svou návratovou politiku vůči nelegálním přestěhovalcům, a jestli je v souladu s zásadními principy návratové politiky EU. Je to zajímavé, protože se v poslední době migrační a obzvlášť readmisní politiky EU setkaly s řadou změn, například v roce 2021 Evropská komise zavedla strategii EU o dobrovolném návratu a reintegraci, která dodává větší pozornost na kooperaci se zeměmi třetího světu a na humanitní přístup k imigrantům. Základní výzkumnou otázkou proto je, jak Španělsko vnímá imigraci a jak implementuje přístupy návratové politiky EU v případě konkrétní cesty iregulární migrace. Práce vychází hlavně z obecného pojetí návratové politiky, zásadní strategie EU o reintegraci, navíc z readmisních dohod a nařízení uvnitř Evropské Unie, které ve výsledku pomohou pochopit, že nehledě na nařízení v oblasti kontroly hranic, větší důraz musí být kladen na kooperaci s třetími zeměmi a na zefektivnění reintegračních programů. Cesta modifikace systému je dlouhá, ale určitě se za to stojí.

Abstract:

Migration to Europe has a long and fascinating history, which also includes a large chapter on migration from African countries. Immigration, as one of the acute topics, is perceived differently in time. So, one of the tasks of this paper is, using the example of one of the current migration routes from Ceuta to the continent, to find out how Spain manages its return policy towards illegal migrants, and whether it complies with the fundamental principles of the EU return policy. This is curious because recently the EU's migration and especially readmission policies have seen a number of changes, for example, in 2021 the European Commission introduced The EU strategy on voluntary return and Reintegration, which puts more emphasis on cooperation with third world countries and on a humanitarian approach to immigrants. Research question is concentrated on Spanish attitude towards immigration and how it implements EU readmission policy approaches in the case of a particular irregular migration route. In the way of theoretical background, this paper is mainly premised on the general concept of return policy, the fundamental EU strategy on reintegration, in addition to readmission agreements and regulations within the European Union, which in the end will help to understand that, apart from border control regulations, greater emphasis must be placed on cooperation with third countries and on making reintegration programs more effective. Modifying the system is a long process but it does worth it.
